Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise of the powers conferred by “The Public Works Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby consent to the land described in the Schedule hereto being taken for the purpose of harbour-works as aforesaid.

Directing Sale of Railway Land under “The Public Works Act, 1908.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this second day of November, 1908.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS by the thirtieth section of “The Public Works Act, 1908” (hereinafter termed “the said Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time under this or any other Act or Provincial Ordinance, or otherwise howsoever, for any public work is not required for such public work, the Governor may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:
And whereas the parcel of land described in the Schedule hereto has been, inter alia, taken for the purposes of the Kaipara-Waikato Railway by a Proclamation dated the eighth day of August, one thousand nine hundred and six, and published in the New Zealand Gazette No. 76, of the sixth day of September, one thousand nine hundred and six, a copy whereof was duly deposited in the office of the District Land Registrar, at Auckland, as Number 2222:
And whereas the said parcel of land is not now required for the purposes of the said Kaipara-Waikato Railway, and the Minister of Railways has recommended that this Order in Council should be issued directing such parcel of land to be sold:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct the sale of the land described in the Schedule hereto.
SCHEDULE.
ALL that parcel of railway land at Ellerslie, in the Auckland Land District, containing by admeasurement 13·2 perches, more or less, being portions of Lots 510, 511, and 512, in Allotment No. 59 of Section 12, in the Suburbs of Auckland, being part of the land comprised in certificate of title, Volume 150, folio 238, in the Lands Registry Office, at Auckland, and being bounded as follows: Commencing at a point at the junction of the south-west side of Panmure Road with the north-west side of said Lot 512; thence south-easterly along the south-west side of Panmure Road by a line at a bearing of 113° 30′ a distance of 13·55 links; again south-easterly by a line at a bearing of 157° 39′ a distance of 169·05 links; thence north-westerly by a line at a bearing of 296° 33′ a distance of 135·05 links; and thence north-easterly along the north-western boundary of said Lot 512 by a line at a bearing of 23° 30′ a distance of 110·55 links to the commencing-point: as the same is more particularly delineated on the plan marked W.R. 16748, deposited in the office of the Minister of Railways, at Wellington, in the Provincial District of Wellington, and thereon coloured blue.

At the Government Buildings, at Wellington, this second day of November, 1908.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Feilding Borough Council lately proposed to raise by special order a special loan of nine hundred pounds for the purpose of paying off a special loan of nine hundred pounds which became due on the first day of October, one thousand nine hundred and eight: And whereas at a special meeting of the Council held in the forenoon of the thirty-first day of August, one thousand nine hundred and eight, a resolution (to operate as a special order) for raising and securing the said loan was duly passed: And whereas the first notice calling a second meeting for the twenty-eighth day of September, one thousand nine hundred and eight, to confirm the said resolution was signed by the Town Clerk after the holding of the said meeting of the thirty-first day of August, one thousand nine hundred and eight, and was published in the Feilding Star of that date, which is a newspaper in general circulation in the district, and which was issued in the evening of the thirty-first day of August, one thousand nine hundred and eight, after the holding of the said meeting on that day: And whereas the subsequent notices calling the second meeting were published in the Feilding Star of the seventh, fourteenth, and twenty-first days of September, one thousand nine hundred and eight: And whereas the meeting confirming the said resolution
