And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the tenth day of September, one thousand nine hundred and eight, the Council of the City of Wellington, the local authority having control of the street known as Regent Street, described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

That street in the City of Wellington, in the Wellington Land District, known as Regent Street, Wadestown, situated between the Main Road and Princess Street, Wadestown; as the said street is more particularly delineated on the plan marked R. 8729, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink, and bordered blue.

Extending Time for holding General Election of Councillors in certain Counties.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of October, 1908.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS by section sixty-five of “The Counties Act, 1908” (hereinafter termed “the said Act”), it is provided that the general election of members of the various County Councils throughout the Dominion shall be held on the second Wednesday in November: And whereas it is expedient to extend the time for holding such election in certain counties:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the powers and authorities vested in him by section two hundred and seventeen of the said Act, and of all other powers in anywise enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby extend the time for holding the general election of Councillors for the Counties of Akaroa, Amuri, Ashburton, Cheviot, Geraldine, Levels, Mount Herbert, Mackenzie, Selwyn, and Waimate, and doth hereby order and declare that in the aforesaid counties the said general election shall be held and take place on Thursday, the nineteenth day of November, one thousand nine hundred and eight, excepting in the Counties of Selwyn and Waimate, in which the said election shall be held on Friday, the twentieth day of the said month of November, and Tuesday, the twenty-fourth day of the said month of November, respectively.

Authorising Thomas Eckford to charge Dues for Goods and Shipping at the Opawa River Wharf, Wairau.

At the Government Buildings, at Wellington, this twenty-second day of October, 1908.

PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the eighth day of August, one thousand eight hundred and ninety-nine, and published in the New Zealand Gazette of the tenth day of the same month, No. 68, Thomas Eckford, of Blenheim (hereinafter called “the licensee”), was duly licensed to occupy part of the foreshore, and of land below low-water mark adjacent thereto, in the Opawa River, Wairau:

And whereas it is desirable to prescribe the dues and charges payable for all goods passing on or over the said wharf, for the use of the crane on such wharf, and for all vessels making use of such wharf:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by “The Harbours Act, 1908,” and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby prescribe that the dues and rates set forth in the Schedule hereto shall be charged and taken by the said Thomas Eckford for the use of the said wharf.
