Preferential and Reciprocal Trade.—Regulation under ''The Tariff Act, 1907.''

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of January, 1908.

IN pursuance and exercise of the powers and authorities conferred on him by “The 'Tariff Act, 1907” (hereinafter referred to as “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulation under “The Preferential and Reciprocal Trade Act, 1903,” dated the seventh day of November, one thousand nine hundred and four, and published in the New Zealand Gazette of the tenth day of November, one thousand nine hundred and four, and in lieu thereof doth hereby make the following regulation for carrying into effect the purposes of the said Act :—

REGULATION.

In every case where, pursuant to section six of the said Act, the full duty under the said Act is payable on any goods owing to the non-production to the Collector of an invoice with the prescribed certificate written or printed thereon, and at the time of importation the importer alleges in writing, and the Collector has reason to believe, that such goods are bona fide the produce or manufacture of some part of the British dominions, and that such non-production is due to accident, the following provisions shall apply :—(a.) Any amount of duty so payable in excess of the duty payable upon the like goods being the produce or manufacture of some part of the British dominions may be held by the Collector at the port of importation on deposit pending the production of an invoice with the prescribed certificate written or printed thereon.

(b.) Such deposit shall be returned to the importer if the invoice, with certificate as aforesaid, is produced within six months from the date of payment of the deposit, but otherwise the same shall be applied as duty payable under the said Act, unless other action is specially directed by the Minister of Customs.

Vesting Land in the Tokerau Maori Land Board under “ The Maori Land Settlement Act, 1905.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of January, 1908.

The Right Honourable Sir J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section eight of “ The Maori Land Settlement Act, 1905,” it is provided that where any Maori land within the Tokerau Maori Land District is, in the opinion of the Native Minister, not required or not suitable for occupation by the Maori owners, the Governor may, by Order in Council, declare that such land is vested in the Board of that district for an estate in fee-simple in possession, subject nevertheless to all valid encumbrances, liens, and interests affecting the same, to be held and administered by the Board for the benefit of the Maori owners in accordance with the provisions of that Act: And whereas the lands described in the Schedule hereto are Maori lands within the said district, and in the opinion of the Native Minister are not required or are not suitable for occupation by the Maori owners thereof:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance of all powers and authorities conferred by the hereinbefore-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the said lands are vested in the Tokerau Maori Land Board for an estate in fee-simple in possession, subject nevertheless to

all valid encumbrances, liens, and interests affecting the same, to be held and administered by the said Board for the benefit of the Maori owners in accordance with the provisions of the said Act.

SCHEDULE.

ALL that area in the Auckland Land District, situated in Blocks XV and XVI, Russell Survey District, and known as Punaruku No. 2 Block, and containing 1,725 acres, more or less. Bounded towards the north generally by Waikare Block ; towards the north-east by Punaruku Block; towards the south generally by Pare mata Mokau Block ; and towards the south-east generally by Taumatahinau Block.

All that area in the Auckland Land District, situated in Blocks XV and XVI, Russell Survey District, III, Whangarruru Survey District, III and IV, Hukerenui Survey District, and I, Opuawhanga Survey District, and known as Pare mata Mokau Block, containing by admeasurement 7,255 acres, more or less. Bounded towards the north-west generally by Punaruku No. 2, Punaruku, and Oakura Blocks ; towards the east generally by Whangaruru Bay; towards the south-east generally by Section No. 11, Block I, Opuawhanga Survey District, the abutment of a road, Sections Nos. 14, 2, 1, 15, and 16, Block I, Opuawhanga Survey District aforesaid, and Section No. 1 of Block IV, Hukerenui Survey District ; and towards the south-west generally by the Taparahaia Stream, the Puhipuhi State Forest, and the Taumatahinau Block.

All that area in the Auckland Land District, situated in Blocks X and XI, Russell Survey District, known as Waihaha Block, and containing 1,143 acres, more or less. Bounded towards the north-west generally by Small Grazingrun No. 12 and the Waihaha River ; towards the east generally by Rev. C. Baker's Old Land Claim, the Putahoihoi Native School Reserve, and again by Rev. C. Baker's Old Land Claim ; towards the south-west generally by the Karetu Block ; and towards the west by the Waikino Block.

All that area in the Auckland Land District, situated in Blocks VIII, IX, and X, Te Kuri Survey District, IX and XIII, Hukatere Survey District, and I. North Head Survey District, and known as Poutu No. 2 Nos. 1 and 2 Blocks, containing by admeasurement 12,726 acres, more or less. Bounded towards the north-east generally by the Wairoa River ; towards the south-east by Poutu No. 2 Nos. 3 and 10 Blocks ; towards the south-west by Tasman Sea ; and towards the north-west by Crown land.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twentysecond day of January, 1908.

The Right Honourable Sir J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section four of “ The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “ The Native Land Court Act, 1894 ” (hereinafter called “ the said Act ”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act : Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette : Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act :

And whereas the Maniapoto-Tuwharetoa District Maori Land Board, by a recommendation made on the twentyseventh day of June, one thousand nine hundred and seven, and received on the twenty-second day of October, one thousand nine hundred and seven, has recommended the Governor to except from the operation of section one
