IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a district road.


SCHEDULE.

ALL that portion of road in the Taranaki Land District, Wairoa Road District, known as the Okotuku Road, commencing at the north-west corner of Section 10, and running in a north-westerly direction along part frontage of Section 9 to the south-east corner of Section 460, all in Block XVI, Opaku Survey District, being a distance of 26 chains, more or less; as the said road is more particularly delineated on the plan marked R. 5161⁷, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.

Declaring Maraetaha Road, in the Wairoa County, to be a County Road.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a county road.


SCHEDULE.

ALL that portion of road in the Hawke’s Bay Land District, Wairoa County, known as the Maraetaha Road, commencing at a point between Sections 4 and 10, Block XI, Nuhaka North Survey District, about four miles from its junction with the Gisborne–Nuhaka Road, and proceeding in a north-westerly direction to a point about 68 chains beyond the west bank of the Nuhaka River, being a distance of 1 mile 38 chains, more or less; as the said road is more particularly delineated on the plan marked R. 9641, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.

WHEREAS by section ten of “The Mining Act, 1905,” it is enacted that the Governor may from time to time, by Order in Council, appoint fit persons to be Wardens, who shall hold office during the Governor’s pleasure:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said section ten of “The Mining Act, 1905,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

THOMAS HUTCHISON, Esq., S.M.,

to be a Warden, to hold and exercise the duties of such office under and subject to the provisions of the said Act during pleasure, on and from the twenty-fifth day of January, one thousand nine hundred and eight.

Prohibiting Net-fishing in Portion of Otago Harbour.

At the Government Buildings, at Wellington, this twenty-second day of January, 1908.

PRESIDING IN COUNCIL.

WHEREAS by the fifth section of “The Sea-fisheries Act, 1894” (hereinafter termed “the said Act”), it is enacted that the Governor in Council may from time to time make regulations, which shall have general force and effect throughout the Dominion, or particular force and effect only in any waters or places specified therein, for, amongst other things, prescribing conditions and restrictions for the regulation of fishing and taking of fish, and for prohibiting the use of any particular tackle or apparatus for taking any fish:

And whereas by Order in Council dated the seventeenth day of June, one thousand nine hundred and seven, and published in the New Zealand Gazette of the twentieth day of the same month and year, certain regulations were made prohibiting the taking of fish by means of nets in the upper portion of Otago Harbour:

And whereas it is desirable to revoke the said regulations of the said seventeenth day of June, one thousand nine hundred and seven, and to substitute others in lieu thereof:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the power and authority conferred by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said regulations of the seventeenth day of June, one thousand nine hundred and seven, and doth hereby make the following regulations in lieu thereof for the purposes of the said Act, and doth order that the same shall come into force from and after the date hereof:—

REGULATIONS.

  1. No person shall haul or use a net for the purpose of taking fish in that portion of Otago Harbour on the upper side of a straight line drawn from a post fixed at high-water mark on a line with the southern boundary of Section 46, Harbour East Survey District, known as Challis’s property, to a point immediately opposite the southern end of the railway-station at Ravensbourne.

  2. Any person committing a breach of clause 1 of these regulations is liable to a penalty of not less than £1 and not exceeding £20.
