SCHEDULE.
HASTWELL-PLECKVILLE ROAD.
ALL that road in the Wellington Land District, Ekatahuna County, known as the Hastwell-Pleckville Road, commencing at its junction with the Mangaoronga Road, a county road, at the southern corner of Section 151, Block X, Mangaone Survey District, and proceeding thence north-easterly until it junctions with the Ekatahuna-Alfredton Road, a county road, at Section 8, Block X, Mangaone, a distance of 2 miles 43 chains, more or less; as the said road is more particularly delineated on the plan marked R. 8573, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink and blue, and marked A.C.

Exempting Watt Road and Part of Kai Iwi Road, Waitotara County, from the Provisions of Section 117 of “The Public Works Act, 1908.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifteenth day of September, 1908.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council :
And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose :
And whereas on the fifteenth day of July, one thousand nine hundred and eight, the Waitotara County Council, the local authority having control of the roads described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said roads :
And whereas it is deemed expedient that such resolution should be approved :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.
SCHEDULE.
ALL that road in the Waitotara County, Wellington Land District, known as Watt Road, situated between Stanley Road and Kai Iwi Road, and marked A.B. on plan; also part of Kai Iwi Road, in the Waitotara County, Wellington Land District, situated between Francis Road and the western corner of Lot 11, subdivision of the Westmere Estate (deposited plan No. 381), and marked C.D. on plan: as the said roads are more particularly delineated on the plan marked R. 9973, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.

THAT road in the Waitotara County, in the Wellington Land District, known as Pukerimu Road, situated between the Great North-western Road and Section 12, Block X, Nukumaru Survey District, and passing through Sections 13 and 41 in the said Block X; as the said road is more particularly delineated on the plan marked R. 10063, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink and blue, and lettered A.B.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifteenth day of September, 1908.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bond fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act :
And whereas the Aotea District Maori Land Board, by a recommendation made on the twentieth day of August, one thousand nine hundred and eight, and received on the twenty-eighth day of August, one thousand nine hundred and eight, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the block or parcel of land particularised and set out in the Schedule hereto :
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale.
