Land taken for a Native School at Matihetihe.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourth day of August, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a certain public work, to wit, a Native school:

And whereas the Native owners have agreed to make a free gift of the said land to His Majesty the King, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:

And whereas by a partition order made by the Native Land Court, bearing date the ninth day of October, one thousand nine hundred and six, certain aboriginal Natives are declared to be the owners of the Moetangi B2 No. 2 Block, within which the said land is situated:

And whereas, as required by “The Public Works Acts Compilation Act, 1905,” a map has been prepared showing accurately the position and extent of the said land, and such map is hereto attached:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Acts Compilation Act, 1905,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the land shown upon the said map, and described in the Schedule hereto, is hereby taken for the purposes of the said Native school, and shall vest in His Majesty the King, as from the twenty-first day of September, one thousand nine hundred and eight.

Native Land taken for the Purposes of a Road in Paremeta No. 4, Block XII, Uawa Survey District, Cook County.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of August, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Paremeta No. 4, Block XII, Uawa Survey District:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said land, as required by the ninetieth section of “The Public Works Act, 1908”:

Now, therefore, in pursuance and in exercise of the powers vested in him by the ninetieth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road as from the eighth day of October, one thousand nine hundred and eight.

Validating the Public Notifications of the Special Order making the Special Rate as the Security for the Loan of £1,164 for the Construction of Drainage-works for that Portion of the Borough of Onslow defined as the Kaiwarra Drainage-area.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fifteenth day of September, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Onslow Borough Council lately proposed to raise a loan of one thousand one hundred and sixty-four pounds for the purpose of constructing drainage-works for that portion of the Borough of Onslow defined by the Council as the Kaiwarra drainage-area: And whereas a special order making a special rate has been made as security for the said loan: And whereas the provisions of section seventy-three, subsection three, of “The Municipal Corporations Act, 1900,” relating to special orders, were not strictly complied with by the said Council, inasmuch, although four public notices of the said special order were given, such notices did not appear once in each of the four weeks immediately preceding the day of the meeting at which the said special order was confirmed, and inasmuch as the public notices were published in three newspapers circulating in the district, instead of one newspaper only: And whereas it appears that the ratepayers have not been misled by such irregularities, and it is expedient to validate the same:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by section one hundred and twenty-one of “The Local Bodies' Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said special order and the public notifications in connection therewith shall be and be deemed to have been as good, valid, and effectual as if the said order and notifications had been regularly made, and that the proceedings relative to the said loan shall not be called in question by reason only of the irregularities aforesaid.
