ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh
day of September, 1908.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities
vested in him by "The Agricultural and Pastoral
Societies Act, 1908," His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby incorporate the members of the Mackenzie
County Agricultural Society, and such persons as shall
hereafter be admitted members of the said society agreeably
to the rules of the said society and the provisions of the
said Act, into a body corporate under the style and title of
"The Mackenzie County Agricultural and Pastoral Society."

Taking of the Account under "The Statistics Act, 1908."

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities
conferred upon him by "The Statistics Act, 1908"
(hereinafter termed "the said Act"), His Excellency the
Governor of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, doth hereby order and direct that the
account described in section twenty of the said Act shall
be taken on the twelfth day of October, one thousand nine
hundred and eight.

Third Schedule of "The Noxious Weeds Act, 1908," ex-
tended to include African Box Thorn.—Notice No. 1238.

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh
day of September, 1908.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities
conferred upon him by "The Noxious Weeds Act,
1908" (hereinafter called "the said Act"), His Excellency
the Governor of the Dominion of New Zealand, acting by
and with the advice and consent of the Executive Council
of the said Dominion, doth hereby extend the operation of
the Third Schedule of the said Act by including therein the
plant known as African box thorn (Lycium horridum); and
it is hereby declared that this Order shall come into force on
the day of publication hereof in the Gazette.

Declaring Additional Diseases under "The Orchard and
Garden Diseases Act, 1908," and extending the Second
Schedule of the Act to include the said Diseases.—Notice
No. 1239.

At the Government House, at Wellington, this seventh
day of September, 1908.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers conferred upon
him by "The Orchard and Garden Diseases Act, 1908,"
His Excellency the Governor of the Dominion of New
Zealand, acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
declare that on and after the date of the gazetting hereof
TOMATO FRUIT-FLY (Lonchæa splendida) and
SHOT-HOLE FUNGUS (Phyllosticta prunicola and
Phyllosticta circumscissa)
shall be diseases within the meaning of the said Act; and
with the like advice and consent doth hereby extend the
Second Schedule to the said Act by including the aforesaid
diseases therein.

Excepting Land from the Operation of Section 117 of "The
Native Land Court Act, 1894."

ORDER IN COUNCIL.
At the Government House, at Wellington, this seventh
day of September, 1908.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of "The Native Land
Laws Amendment Act, 1895," it is enacted that the
Governor may, by Order in Council, except from the opera-
tion of section one hundred and seventeen of "The Native
Land Court Act, 1894" (hereinafter called "the said Act"),
for a limited period or otherwise, and either generally or
for such purposes and subject to such restrictions as shall
be in such Order specified, any land, wheresoever situate,
which is for the time being subject to the operation of the
said section, or any interest therein or right over the same,
or may in like manner make such exception in favour exclu-
sively of any lessee or other person who has been bona fide
in occupation of and has made improvements on such land,
or has paid money to Native owners for lease or purchase
thereof, prior to the passing of the said Act: Provided that
no Order in Council under the provisions of this section
shall take effect until after the expiration of two months
from the date of the publication thereof in the Gazette:
Provided also that every alienation under the provisions of
this section shall be confirmed by the Court in terms of
section fifty-three of the said Act:

And whereas the Maniapoto-Tuwharetoa District Maori
Land Board, by a recommendation made on the twenty-
fifth day of August, one thousand nine hundred and eight,
and received on the twenty-ninth day of August, one
thousand nine hundred and eight, has recommended the
Governor to except from the operation of section one
hundred and seventeen of "The Native Land Court Act,
1894," for the purpose of alienation by way of lease, the
block or parcel of land particularised and set out in the
Schedule hereto:

Now, therefore, His Excellency the Governor of the Do-
minion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by section four
of "The Native Land Laws Amendment Act, 1895," and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby except the said
land from the operation of section one hundred and
seventeen of "The Native Land Court Act, 1894," for the
purpose of alienation by way of lease for a term not ex-
ceeding twenty-one years.

SCHEDULE.
ALL that piece or parcel of land, situate in the Ohinewairua
Survey District, containing 91 acres and 35 perches, more
or less, and known as Awarua 3D3 No. 7, and comprised in
a partition order of the Native Land Court dated the 2nd
day of December, 1896, in favour of Hirata Ngapaki and
another.

WHEREAS, there being no Harbour Board empowered
to grant the license hereinafter mentioned, the
Upper Waikawa Sawmilling Company (Limited), (herein-
after called "the company"), has applied to the Governor
in Council for a license under "The Harbours Act, 1908"
(hereinafter called "the said Act"), to occupy a part of the
