Warrant authorising the Kowai Road Board to construct a
Bridge on the Main North Road, in the Kowai Road
District, and apportioning the Cost.
PLUNKET, Governor.
WHEREAS by section one hundred and eighteen of
“ The Public Works Act, 1905 ” (hereinafter termed
“ the said Act ”), it is, inter alia, enacted that in any case
where the local authority of any district desires to construct
a bridge, or to establish a ferry or ford, in any position that
will, in its opinion, be of advantage or benefit to the whole or
any considerable portion of the inhabitants of an adjacent
district, as well as to the inhabitants of its own district, and
where it is, in the opinion of such local authority, reasonable
that the local authority of such adjacent district should con-
tribute to the cost of constructing or establishing the said
bridge, ferry, or ford, the provisions of the said section shall
have effect:
And whereas the Kowai Road Board has given notice and
taken the steps required by the said Act, and has made
application to the Governor to authorise the construction of
the bridge mentioned in the Schedule hereto, and hereinafter
referred to as “ the said bridge ” or as “ the work,” and to
apportion the cost of constructing and establishing the said
bridge or work between the said Council and certain other
local authorities:
And whereas it is also provided in the said Act that the
Governor (with the view of determining whether or not the
work should be done, or what proportion, if any, of the cost
of the same should fairly be borne by any local authority, or
what local authority should do the work) may direct any
Magistrate or other person to be a Commissioner to inquire
into and report to him on the matter:
And whereas a Commissioner was appointed, and an inquiry
was duly held, in the manner provided by the said Act, in
respect to the said bridge, and in respect also to the ap-
portionment of the cost of constructing the said bridge:
And whereas such Commissioner did report to the Governor,
after due inquiry, his opinion as to the matters respecting
which he was appointed to report:
And whereas I am of opinion that the work should be done,
and it is expedient to make provision under the said Act for
the purposes and in the manner hereinafter set forth:
Now, therefore, I, William Lee, Baron Plunket, the
Governor of the Dominion of New Zealand, in pursuance
and in exercise of the powers vested in me by the said Act,
and of all other powers and authorities in anywise enabling
me in this behalf, do hereby authorise the Kowai Road
Board to execute the work; and I do hereby declare that the
cost thereof shall be borne by the Kowai Road Board in the
proportion of sixty per centum, by the Mandeville-Rangiora
Road Board in the proportion of twenty-five per centum, by
the Waipara Road Board in the proportion of seven per
centum, by the Amuri County Council in the proportion of
six per centum, and by the Amberley Town Board in the
proportion of two per centum of such cost respectively.
And I do also further direct that any contribution hereby
required to be made as aforesaid by the Mandeville-Rangiora
Road Board, the Waipara Road Board, the Amuri County
Council, and the Amberley Town Board shall be paid from
time to time in the proportions hereinbefore prescribed out
of the funds of the said Road Boards, County Council, and
Town Board, within a period of thirty days after demand in
writing made by or on behalf of the Kowai Road Board, and
such payments shall be made from time to time to the Clerk
of the said Road Board for and on account of such Road
Board.
