J. F. ANDREWS,
Acting Clerk of the Executive Council.

Warrant authorising the Lake County Council to construct a Bridge over the Shotover River (on the Queenstown to Arrowtown Road, via Lake Hayes), and Approaches thereto, and apportioning the Cost.

PLUNKET, Governor.

WHEREAS by section one hundred and eighteen of "The Public Works Act, 1905" (hereinafter termed "the said Act"), it is, inter alia, enacted that in any case where the local authority of any district desires to construct a bridge in any position that will, in its opinion, be to the advantage and benefit of the whole or any considerable portion of the inhabitants of an adjacent district, as well as to the inhabitants of its own district, and where it is, in the opinion of such local authority, reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing the said bridge, the provisions of the said section shall have effect:

And whereas the Lake County Council has taken the steps required by the said section, and has made application to the Governor to authorise the construction of the bridge and approaches mentioned in the Schedule hereto (hereinafter referred to as "the said bridge"), and to apportion the cost of constructing the said bridge between the said Council, the Queenstown Borough Council, and the Arrowtown Borough Council:

And whereas the Governor is of opinion that such work should be done, and it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, do hereby authorise the Lake County Council to construct the said bridge; and I do declare that the cost of constructing the said bridge, less such amount by way of contribution as may be made thereto by the Government of New Zealand, shall be borne in the following proportions—namely, the Queenstown Borough Council shall contribute the sum of twenty-five pounds (£25), the Arrowtown Borough Council shall contribute the sum of fifty pounds (£50), and the Lake County Council shall contribute the remainder of the money required, less the contribution aforesaid of the Government of New Zealand.

And I do hereby also further direct that any contribution hereby required to be made as aforesaid by the Queenstown Borough Council or by the Arrowtown Borough Council out of the funds of the said Borough Councils respectively shall be paid out of the funds of the said Borough Councils, within a period of thirty days after demand in writing made by or on behalf of the Lake County Council, and all such payments shall be made to the Clerk of the said County Council for and on account of such Council.

SCHEDULE.

As witness the hand of His Excellency the Governor, this second day of January, one thousand nine hundred and eight.

JAMES McGOWAN,
Acting Minister for Public Works.

Warrant Vesting Control of the Wairoa Bridge, at Clyde, in the Wairoa County, and apportioning the Cost of Maintenance of the same between the Clyde Town Board and the Wairoa County Council.

PLUNKET, Governor.

WHEREAS by section one hundred and nineteen of "The Public Works Act, 1905" (hereinafter called "the said Act"), it is, inter alia, enacted that the Governor may, by Warrant under his hand publicly notified and gazetted, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by any such Warrant as aforesaid fix and determine whether all or any, and if so what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities, and, if so, by what local authority or authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas by the said Act it is further provided that the Governor may from time to time, with the view of determining whether it is expedient to vest the exclusive care, control, management, and maintenance of any such bridge in any local authority, direct any person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question as aforesaid; and may by any subsequent Warrant, publicly notified from time to time, vary or alter such care, control, and management:

And whereas a Commissioner was appointed, under the provisions of section one hundred and nineteen of "The Public Works Act, 1905," and an inquiry was duly held, with a view to determine what local authority could most conveniently and efficiently control the bridge known as the Wairoa Bridge, at Clyde, mentioned in the Schedule hereto, and hereinafter referred to as "the said bridge," and what proportion of the cost of maintaining, repairing, improving, or reconstructing the said bridge should be paid by any, and if so which, local authority or authorities: And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report:

And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authorities in anywise enabling me in this behalf, do hereby direct that the bridge known as the Wairoa Bridge, at Clyde, as described in the Schedule hereto (hereinafter referred to as "the said bridge"), shall, from and after the date of this Warrant, be under the exclusive care and control and management of the Wairoa County Council; and, in further pursuance and exercise of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge, with the approaches thereto and protective works, shall be borne by the Council of the County of Wairoa in the proportion of three-fourths of the said cost, and by the Clyde Town Board in the proportion of one-fourth of the said cost respectively.

And I do also further direct that any contribution hereby required to be made as aforesaid by the Clyde Town Board shall be paid from time to time in the proportion hereinbefore prescribed out of the funds of the said Board, within a period of thirty days after demand in writing made by or on behalf of the Council of the County of Wairoa, and such payments shall be made from time to time to the Clerk of that Council for and on account of such Council.
