Revoking Regulations under “The Tobacco Act Amendment
Act, 1896,” and prescribing other Regulations in lieu
thereof.

PLUNKET, Governor.
ORDER IN COUNCIL
At the Government House, at Wellington, this twenty-
second day of July, 1908.
Present:
His Excellency The Governor in Council.

IN pursuance and exercise of the power and authority
conferred on him by section fourteen of “The Tobacco
Act Amendment Act, 1896” (hereinafter termed “the said
Act”), and of all other powers and authorities him enabling
in this behalf, His Excellency the Governor of the Dominion
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby
revoke the Order in Council and regulations made under
the said Act on the eleventh day of January, one thousand
eight hundred and ninety-seven, and published in the New
Zealand Gazette of the twenty-eighth day of January then
instant, and in lieu thereof doth hereby make the following
regulations for the purpose of determining the scale of fees
to be paid for licenses under “The Tobacco Act, 1879.”
And it is hereby declared that the said revocation and these
regulations shall take effect on and after the date of the
publication thereof in the New Zealand Gazette.

REGULATIONS.

  1. The scale of fees to be paid for licenses to manufacture
    tobacco shall be as follows:-
    By each licensee-
    For an estimated production for the year of not more than 25,000lb. manufactured tobacco (including therein cigars, cigarettes, and snuff)

For more than 25,000 lb., but not more than
50,000 lb.

For more than 50,000 lb., but not more than 100,000 lb.

For more than 100,000 lb.

Provided that when a license is issued later in the year than the month of January the sum to be paid for it, and the quantity permitted to be manufactured under these regulations, shall be proportionate to the unexpired portion of the year.
2. The fee shall in each case be payable to the Collector of Customs issuing the license, and before the issue thereof.

Regulations as to Taking of Whitebait.

ORDER IN COUNCIL
At the Government House, at Wellington, this twenty-
eighth day of July, 1908.
Present:
His Excellency The Governor in Council.
WHEREAS it is provided by section five of “The Sea-
fisheries Act, 1894” (hereinafter called “the said
Act”), that the Governor in Council may from time to time
make regulations, which shall have general force and effect
throughout the Dominion, for the matters specified in that
section:
And whereas by Order in Council dated the twenty-third
day of May, one thousand nine hundred and six, and published in the New Zealand Gazette of the thirty-first day of
the same month, certain regulations were made under the
said Act providing, amongst other things, for the size of
opening of scrim hand-nets used for taking whitebait:
And whereas it is desirable to amend such regulations:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and exercise of the
power and authority conferred upon him by the said Act,
and acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby make
the following regulations:-

REGULATIONS.

  1. Scrim hand-nets having an opening of seven square
    feet may be used for the purpose of catching whitebait
    within the Provincial District of Otago.
  2. Any person committing a breach of the foregoing regulation shall be liable to a penalty of not less than one pound
    and not exceeding twenty pounds, except where otherwise
    specially provided.

    Exempting Roads in the Windsor Park Estate, Waitaki
    County, from the Provisions of Section 117 of “The
    Public Works Act, 1905.”

At the Government House, at Wellington, this twenty-second day of July, 1908.
Present:
His Excellency The Governor in Council.
WHEREAS by subsection one of section one hundred
and seventeen of “The Public Works Act, 1905,” it
is, inter alia, provided that the said section shall not apply
in any case where the local authority having control of a
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council:
And whereas by section three of “The Public Works Act
Amendment Act, 1906,” it is provided that such approval
may be either absolute or subject to such conditions as the
Governor by Order in Council thinks fit to impose:
And whereas on the twenty-seventh day of May, one
thousand nine hundred and eight, the Waitaki County
Council, the local authority having control of the roads adjoining the Teanaraki and Windsor Park Settlement, being
the roads described in the Schedule hereto, did by resolution
declare that the provisions of the said section one hundred
and seventeen should not apply to the said roads:
And whereas it is deemed expedient that such resolution
should be approved:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, in pursuance and in exercise of
the powers conferred by the above-in-part-recited Acts, and
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby approve of the
said resolution.

SCHEDULE.
ALL that road on the south-eastern boundary of the Windsor
Park Estate, Waitaki County, commencing from its junction
with the main road to Oamaru, and proceeding thence in a
north-easterly and then easterly direction for a distance of
8 chains to the south-eastern corner of Section 7 of the said
estate.
Also that road commencing from the said corner of
Section 7, and proceeding in a northerly direction along the
western boundary of part of Teanaraki Village Settlement
to a point on the western boundary of Windsor Park Settlement, a distance of 5\frac{3}{4} chains.
As the said roads are more particularly delineated on the plan marked R. 3539, deposited in the office of the Chief
Engineer of Roads, at Wellington, in the Wellington Land
District, and thereon coloured green.

Exempting Road in Glenkenich District, Tuapeka County,
from the Provisions of Section 117 of “The Public Works
Act, 1905.”

At the Government House, at Wellington, this twenty-eighth day of July, 1908.

His Excellency The Governor in Council.
WHEREAS by subsection one of section one hundred
and seventeen of “The Public Works Act, 1905,”
it is, inter alia, provided that the said section shall not
apply in any case where the local authority having control
of a road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved

Amendment Act, 1905,” it is provided that such approval

And whereas on the eighth day of May, one thousand
nine hundred and eight, the Council of the County of
Tuapeka, the local authority having control of the road
fronting Sections 12 and 15, Block XV, Glenkenich District,
being the road described in the Schedule hereto, did by
resolution declare that the provisions of the said section one
hundred and seventeen should not apply to the said road:
