The objects of the said application and Bill are as follows :—
- To enable the Board to purchase or take compulsorily, under the provisions of “The Public Works Act, 1905,” the right, title, and interest of the Wellington Patent Slip Company (Limited) in certain lands comprised in certificates of title, Volume 20, folio 127, and Volume 21, folio 287, and described in the Seventh and Eighth Schedules to the proposed Bill, and shown as such Schedules on a plan deposited in the office of the Marine Department, in Wellington, and marked M.D. 3187, together with the buildings, machinery, plant, and assets of the company, and all rights, privileges, and appurtenances appertaining thereto, and on such acquisition to enable the Patent Slip Company to wind up under the provisions of sections 262 to 265 (both inclusive) of “The Companies Act, 1903,” and to enable the Board to deviate the existing road through the said lands.
- To enable the Board to purchase or take compulsorily, under the provisions of “The Public Works Act, 1905,”—
(a.) All those three pieces of land being parts of Sections 5 and 7 on the plan of the Evans Bay District, containing together an area of about 3 roods 30 perches, together with all foreshore rights of access, bathing, and all other privileges and powers over so much of the foreshore at Evans Bay as lies between the eastern and western portions of the said lands; such pieces of land are described in the Third Schedule to the proposed Bill, and shown as such Schedule on the said plan marked M.D. 3187.
(b.) All that piece of land being so much of Section 2 on the plan of the Evans Bay District, containing an area of about 1 rood 14 perches, as lies to the seaward side of the Evans Bay Road, and is described in the Sixth Schedule to the said Bill, and shown as such Schedule on the said plan marked M.D. 3187. - To provide that the Compensation Court in determining the amount of compensation to be paid in respect of lands compulsorily taken shall not take into account any increase of value arising from the works of the Board, and also enabling the Board to convey land in lieu of paying money awarded for compensation.
- To provide that certain lands in Evans Bay covered by water shall vest in the Board, and empowering the Board to reclaim the same and execute works thereon; such lands are described in the Fifth and Ninth Schedules to the proposed Bill, and shown as such Schedules on the said plan marked M.D. 3187.
- To authorise the Board to construct streets and works ancillary thereto on any land referred to in the proposed Bill.
- To exempt all lands to be reclaimed under the authority of the proposed Bill from payment of rates so long as they remain the property of the Board and are not let or leased.
- To enable the Board to close certain existing streets in the Borough of Miramar, being the streets comprised in the land described in the Second Schedule to the proposed Bill, and shown as such Schedule on the said plan marked M.D. 3187, and to construct in lieu thereof and in addition thereto certain other streets on lands vested and to be vested in the Board, and providing that so long as the lands described in the First and Second Schedules to the proposed Bill, and shown as such Schedules on the said plan marked M.D. 3187, shall remain the property of the Board and not be let or leased the rates payable by the Board shall remain the same as at present.
To empower the Board and the Corporation of the Borough of Miramar to carry out an agreement providing for the closing of streets on the land referred to in the First and Second Schedules to the proposed Bill, and shown as such Schedules on the said plan marked M.D. 3187, and on such closure and on the Board constructing other streets in lieu thereof to convey the same to the Board, and empowering the Board to convey portion of the lands described in the said Schedules to the Miramar Borough for street purposes, and providing that so long as the lands described in the said Schedules shall remain the property of the Board and not be let or leased the rates payable by the Board shall remain the same as at present. - To enable the Board, for the purpose of rectifying boundary-lines, street-levels, and providing access, to purchase or take in exchange adjoining lands, or sell or give in exchange lands the property of the Board.
- To vest in the Board certain lands in Evans Bay being land covered by water, and being the land described in the Tenth and Eleventh Schedules to the proposed Bill, and being shown as such Schedules on the said plan marked M.D. 3187.
- To vest in the Board the lands upon which the boat-sheds at Clyde Quay are constructed, being the lands described in the Twelfth Schedule to the proposed Bill, and shown as such Schedule on a plan deposited in the office of the Marine Department, in Wellington, and marked M.D. 3188.
- To enable the Board to apply to a Court constituted under the proposed Bill and “The Public Works Act, 1905,” to obtain payment from each and every person having any estate or interest in land being a part of the lands comprised in Sections 2 to 8 (inclusive) on the plan of the Evans Bay District, and Sections 1 to 19 (both inclusive) on the plan of the Watts Peninsula District, for the increased value given to the said lands through the works of the Board.
- To enable the Board to borrow £1,000,000 wherewith to construct, execute, perform, and pay for the following works, acts, matters, and things, or such of them as the Board may in its discretion think fit, with such modification and amendment as to the Board may seem meet: The purchase of the undertaking and of all lands authorised to be acquired under this Act, including the expenses of acquisition; the construction and equipment of patent slips; the installation of workshops, plant, and machinery in connection with graving-docks and slips; the reclamation of any lands which the Board is or may be authorised to reclaim, including the purchase of all lands necessary, in the opinion of the Board, for such reclamation, either for spoil purposes or for purposes of providing access to or road frontages for such reclamations, including the cost of retaining-walls, the construction of sewers and watercourses and of streets; dredging, and the purchase, hire, and maintenance of dredging appliances and other expenditure connected therewith; the construction of quays and quay-walls, pitched slopes, and works of a like nature; the extension of existing wharves and stores, and the construction of new wharves, jetties, sheds, offices, and stores, and of cranes, and of other machinery, plant, and appliances; other harbour-works; the expenses of the flotation of the loan or any portion thereof.
The Petition and the proposed Bill and plans will be presented and deposited at the office of the Examiner of Standing Orders either before or within fourteen days after the commencement of the said session.
Plans, including copies of the said plans marked M.D. 3187 and M.D. 3188, books of reference, and a copy of the Gazette containing this advertisement, will be deposited for public inspection at the office of the Commissioner of Crown Lands, at Wellington, not less than thirty days before the commencement of the said session.
At or within ten days after the commencement of the said session a printed copy of the proposed Bill will be deposited in the office of the Minister of Internal Affairs.
