CONDITIONS.

  1. Intending tenderers are expected to visit the locality and to satisfy themselves in every particular on all matters relating to their tender.

  2. The aforementioned quantities, qualities, and kind as to the said timber shall be taken as sufficiently accurate for the purpose of this sale; and no contract for purchase shall be voidable, nor shall the successful tenderer be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated hereon or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated hereon.

  3. No tender will be considered wherein a less royalty is offered for kauri than the upset prices as stated in terms of each lot, and for totara not less than 1s. 6d. per 100 sup. ft.; other timbers not less than minimum schedule rates of royalty in terms of the Timber Regulations.

  4. All timber on each lot, whether standing or in logs, shall remain the property of the Crown until all the instalments are paid.

  5. The successful tenderer shall make and deliver to the Commissioner of Crown Lands, quarterly, or at a period fixed by the Commissioner, a statement, with statutory declaration, of the number of trees felled, and showing the numbers scribed by the Crown thereon; also the total quantity of timber felled and removed under each cutting license.

  6. In all lots the quantities stated are standing measurements.

  7. Should any dispute arise as to boundaries, the decision of the Commissioner of Crown Lands shall be final.

  8. Offers will be considered from the successful tenderers for the purchase of the faulty and undersized trees standing on each lot as stated.

  9. In the event of any of the above lots not being disposed of, consideration will be given to applications made at any time within six months from the above date of closing of tenders (unless previously formally withdrawn), providing, however, that the amount offered is not less than the upset price stated hereon.

  10. No extension of time for removal of timber will be allowed successful tenderers who bleed kauri-trees included in this sale unless full payment of purchase-money is made.

  11. All tenders must be submitted on forms which will be supplied on application to the above office, and envelopes enclosing same to be marked “Tender for Timber,” and addressed to the Commissioner of Crown Lands, Auckland.

  12. The highest or any tender not necessarily accepted.

TERMS.

Separate tenders for the various lots of timber must be accompanied with a deposit of 5 per cent. on the amount of tender, in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, as specified in the terms of each lot.

All such instalment-payments shall bear interest at the rate of 5 per cent. per annum as from the date of acceptance of tender, and, with the interest, shall be secured by promissory notes made and indorsed to the satisfaction of the Commissioner of Crown Lands.

NOTICE is hereby given, in pursuance of section 240 of “The Land Act, 1892,” that the undermentioned land will be disposed of to the holder of adjoining land, under section 114 of the said Act, on or after Wednesday, the 11th day of March, 1908.

All that area, containing by admeasurement 42 acres, more or less, situated in Blocks VII and VIII, Matiri Survey District. Bounded towards the south-east by a road 1 chain wide along the Owen River, towards the south-west by Crown land, and towards the north-west by a road.

Situated about three-quarters of a mile from Longford Post-office and Telegraph-station, and about 10 chains off the main coach-road—Nelson to Westport. Portion of the block known as the Matiri Valley Block. Open and forest-clad land, the timber being brown-birch and silver-birch, not suitable for milling. Formation, sandstone and conglomerate. Soil is very fair, and well watered. Northern and western portions of the area lie well to the sun, and when cleared will carry good grass.
