Special Order made by the Epsom Road Board, County of Eden, making By-laws.

THE following special order, made by the Epsom Road Board, is published in accordance with the provisions of “The Road Boards Act, 1908.”

EPSOM ROAD BOARD.

By-laws of the Body Corporate under the Name of “The Inhabitants of the Epsom Road District” made and enacted by the Epsom Road Board.

IN pursuance of the powers vested in it by “The Road Boards Act, 1908,” “The Public Works Act, 1908,” and by all or any other statutes it hereunto enabling, the Road Board of the Epsom Road District doth hereby make and enact the following by-laws (to come into operation on the gazetting thereof), namely:—

  1. From and after the coming into operation of these by-laws the erection of any building within the boundaries of the Epsom Road District shall not be commenced or proceeded with until the person who proposes to carry out such work shall have made application to the Clerk in the form set out in the Second Schedule to this by-law, and shall have obtained the permission herein mentioned authorising the erection of such building.

  2. Such person shall at the time of making the said application lodge with the Clerk complete plans showing the block-plan and sections of the said site, and the measurements of the height and distance from the boundaries of such dwellinghouse, as required by the provisions of the Board’s by-laws. Such plan and sections shall be in ink and on drawing-paper or tracing-cloth, and shall be to a scale of not less than ⅛ in. to the foot; provided always that if the work proposed to be carried out is of such a trivial nature as in the opinion of the Building Committee not to require the preparation of such plans and sections, such committee may dispense with their production. If the Building Committee are satisfied that all conditions required by all the by-laws of the Board are or can be fulfilled by the proposed works as described in such plan, and after payment of the fees set forth in the First Schedule hereto, a permit for the erection of the building shall be issued by the Clerk.

  3. The erection of a building, dwellinghouse, or residence upon vacant land, or upon a site previously occupied by any building, or the re-erection of any building, dwellinghouse, or residence pulled down to within 4 ft. of the ground floor, or the conversion into a building, dwellinghouse, or residence of any building not originally constructed for human habitation, or the conversion into one or more buildings, dwellinghouses, or residences of a building originally constructed as one building, dwellinghouse, or residence only, or an addition or raising of an existing building, dwellinghouse, or residence (so far as such addition or raising is concerned), shall be deemed to be the erection of a building within the meaning of these by-laws.

  4. Every chimney, shaft, or flue hereafter built, raised, or repaired, and belonging to or forming part of any building, must be carried up in brick, stone, or concrete to a height of not less than 3 ft. above the highest part of such portion of the roof, flat, or gutter adjoining thereto, measured at the point of junction of such roof, flat, or gutter with the said chimney, provided that no other higher roof, flat, or gutter (being part of the same building) is within a radius of 10 ft. from each chimney. In any case where the last-mentioned roof, flat, or gutter is distant less than 10 ft. from the said chimney the latter shall be erected or raised to a height of not less than 3 ft. above the top ridge of such roof, flat, or gutter.

The common seal of the inhabitants of the Epsom Road District was affixed to the foregoing by-laws, this 8th day of December, 1908, in presence of—

FIRST SCHEDULE.

THERE shall be paid in respect of every permit issued under clause 2 of the above by-laws the following fees:—

For any building of less than £100 in value, a fee of 5s.

For any building of the value of £100 and upwards, a fee of 10s.

SECOND SCHEDULE.

Application for Permit.

I hereby certify that the foregoing by-laws were duly made by the Epsom Road Board by special order, the resolution in respect of which was passed at a special meeting of the said Board convened for that purpose on the 10th day of November, 1908, and confirmed at a subsequent meeting of the said Board held on the 8th day of December, 1908; and that all public notifications as required by “The Road Boards Act, 1908,” have been duly complied with in respect of such special order.
