the said Regulation 5, and doth make and substitute the following regulation in lieu thereof:—

  1. (1.) The scale of fees payable for warrants under subsection 1, (b), of section 8 of the said Act shall be as follows:— For an annual warrant to make cigarettes, £1 for every 100,000 cigarettes intended to be made as specified in the declaration of the manufacturer made in accordance with Schedule B.

(2.) No further warrant shall be issued in the event of the quantity stated in any annual warrant being completed.

Consenting to closing Roads in Block V, Greenburn Survey District, and Block IX, Mount Fyffe Survey District, County of Kaikoura.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of December, 1907.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section one hundred and thirty-three, (a), of “The Public Works Act, 1905,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:

And whereas the Kaikoura County Council has applied for such consent in respect to the roads described in the Schedule hereto:

Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Kaikoura County Council closing the roads mentioned in the Schedule hereto.

Exempting Victoria Road, Khandallah, in the Borough of Onslow, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of December, 1907.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the eleventh day of September, one thousand nine hundred and seven, the Council of the Borough of Onslow, the local authority having control of the street known as Victoria Road, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.


SCHEDULE.

That street known as Victoria Road, Khandallah, in the Borough of Onslow, commencing from the eastern corner of Section A747, and proceeding generally in a northerly direction for a distance of about 25 chains to the Wellington-Manawatu Railway; as the said street is more particularly delineated on the plan marked R. 9276, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.
