Exempting Hanson Street, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of December, 1907.

PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the sixth day of June, one thousand nine hundred and seven, the Council of the City of Wellington, the local authority having control of Hanson Street, in the City of Wellington, described in the First Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street; but this latter provision shall not affect the land described in the Second Schedule hereto.

FIRST SCHEDULE.

THAT street in the Wellington Land District and City of Wellington, known as Hanson Street, commencing at its junction with Drummond Street and proceeding in a southerly direction, and terminating at a point 17½ chains, more or less, past its junction with Hall Street, being a distance of 47½ chains, more or less; as the said street is more particularly delineated on the plan marked R. 9299, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

SECOND SCHEDULE.

THAT piece of land having a frontage of 70 ft. to Hanson Street and 31 ft. 6 in. to Hall Street, being the south-east corner section at the junction of Hall and Hanson Streets, and being portion of Section 928, City of Wellington; as the said section is more particularly delineated on the plan marked R. 9299, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured blue.

Exempting Jessie Street, Khandallah, and a Short Blind Street (unnamed), in the Borough of Onslow, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said streets within a distance of thirty-three feet from the centre-line of the said streets.

SCHEDULE.

THAT street known as Jessie Street, Khandallah, in the Borough of Onslow, commencing at a point of junction with Porirua Road, and proceeding for a distance of 15·6 chains, more or less, along the eastern front of Subdivision 5 of Section 3, Porirua District, Block XI, Belmont Survey District; thence through the said Section 5 in a south-west and generally northerly direction a distance of 16 chains, more or less; also from a point on the eastern boundary of the said Section 5, and proceeding in a north-easterly direction along the north-western boundary of Subsection 6 of the said Section 3, Porirua District, a distance of 6¼ chains, more or less: as the said street is more particularly delineated on plan marked R. 9276c, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured pink, and lettered A.B., B.C.D., and B.E.

Also a short blind street (unnamed), in the Borough of Onslow, commencing from a point on the Porirua Road, and proceeding generally in a westerly direction along the frontage of Subdivisions 17 and 15 for a distance of 5½ chains, more or less; as the said street is more particularly delineated on the plan marked R. 9276c, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured pink, and lettered F.G.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this sixteenth day of December, 1907.

PRESIDING IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the road in the Te Puke Road District described in the Schedule hereto shall, on and after the date of this Order in Council, be a district road.

SCHEDULE.

PAPAMOA NO. 2 ROAD.

ALL that portion of road in the Auckland Land District, known as the Papamoa No. 2 Road, commencing at a point at the junction with the old road in Section 17, Block III, Te Tumu Survey District; thence in a northerly direction
