A PROCLAMATION.
WHEREAS by “The Scenery Preservation Act, 1903” (hereinafter referred to as “the said Act”), it is, inter alia, enacted that the Governor may appoint a Commission who may inspect any lands possessing scenic or historic interest, or on which there may be thermal springs, and report thereon to the Governor, with recommendations as to what lands should be reserved as scenic, thermal, or historic reserves: And whereas such Commission was duly appointed, and, after inspection, recommended that the parcel of land described in the Schedule hereunder should be permanently reserved for thermal purposes, and it is expedient to give effect to such recommendation:
Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers contained in the said Act, and of “The Scenery Preservation Amendment Act, 1906,” do hereby proclaim and declare that the parcel of land described in the Schedule hereunder shall be reserved under and subject to the provisions of the said Acts.
SCHEDULE.
KATIKATI (WAIORA) HOT SPRINGS.
ALL that area in the Auckland Land District, containing by admeasurement 100 acres, more or less, being Section 67, Block VIII, Katikati Survey District. Bounded towards the north-west by Sections 49, 48, and 47 of the said block, 2308 links; towards the east by Section 46 of the said block, 5201 links; towards the south by a public road, 649, 698, and 586 links respectively; and towards the west by Section 68 of the said block, 4445 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 39704/15, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Making Regulations for the Netting and Sale of Sea-trout.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-first day of October, 1907.

His Excellency the Governor in Council.
IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” and its amendments, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of the said Acts, and doth hereby declare that such regulations shall have effect in the waters of the Dominion specified in the First Schedule to such regulations, and doth hereby further declare that these regulations shall come into force on the first day of November, 1907:—
REGULATIONS.

Licenses to net for trout within the waters and places in the Southern District Trout-netting Area, as specified in the First Schedule hereto, may be issued under the hand of the Collector of Customs at Invercargill, Dunedin, or Oamaru, respectively, on payment of a fee of one pound for each net, subject to the provisions of these regulations. Every such license shall be in the form or to the effect of form No. 1 in the Second Schedule hereto.

The season for netting trout in the waters aforesaid shall begin on the first day of November in each year and close on the last day of February following. Any other period of the year shall be deemed and is hereby declared to be the close season for the purposes of these regulations.

No nets of a smaller mesh than 4 in. diameter when wetted and stretched ready for use shall be used in any of the said waters or places, and any trout under 15 in. in length caught in any net shall be forthwith returned to the water. The size of the mesh, in every case, shall be ascertained by measuring the length between knot and knot of opposite corners with the mesh closed, the net being first wetted and stretched, and being tanned, barked, or otherwise prepared for use. In case of dispute or doubt, a ½ lb. weight shall be slung or attached to one knot of the mesh, in order to produce a fair strain or extension, and the space between the top and bottom knot shall be measured forthwith while the mesh remains extended. If the net to be measured is dry, the part to be measured shall be soaked either in fresh or salt water for not less than ten minutes, and the mesh so soaked shall then be measured. No set-net shall be used at any time, and all nets, boats, gear, and tackle used shall be subject to inspection by any Collector of Customs, fisheries officer, constable, or officer of the local acclimatisation society at all reasonable times.

No netting for any purposes whatever shall be allowed within a radius of half a mile seawards from the mouth of any river or stream, whether such river or stream be flowing into an estuary or directly into the sea.
For the purposes of these regulations the mouth of every such river or stream shall be deemed to be the point or line where the waters of such river or stream meet those of the sea or of any harbour at low water, spring tides, and shall include every outlet of such waters and the sea-shore between such outlets.
The minimum penalty for breach of this regulation shall be the sum of five pounds, exclusive of any forfeiture declared.

Any holder of a license to net trout may net for and take trout in the waters and places aforesaid from the 1st day of November in one year to the last day of February in the following year, according to the tenor of such license; but every such license shall be for one season only, and shall expire on the last day of the month of February following the grant thereof, or then instant, as the case may be.

Except as aforesaid, no person shall fish with or use any instrument, device, or means for taking trout in any of the said waters or places, or at or near the mouth or entrance of any river or stream.

Any holder of a license to net trout under these regulations may sell and dispose of trout so netted to any bona fide fishmonger who is the holder of a license to retail such trout to the public.

Licenses to sell trout taken under these regulations to the public may be issued to any bona fide fishmonger resident within the Dominion by a Collector of Customs authorised to issue a license to net trout under these regulations on payment of a fee of one pound. Such license shall be in the form or to the effect of form No. 2 set forth in the Second Schedule hereto.
