New Zealand, to sit with the above-named Commissioners, and to act as Chairman, and to exercise equal jurisdiction with them in respect of the determination of the matters aforesaid: And whereas on the 12th and 13th days of September, 1907, the Court of inquiry constituted by the said Act sat at Timaru and heard the evidence tendered by the said parties, and what the said parties by their respective counsel desired to allege and argue in the premises.
The said Commissioners and Judge, sitting as such Court as aforesaid, do decide as follows:--

On and from the 1st day of January, 1908, the Borough of Waimate shall be included in the Timaru Harbour District.

The terms of inclusion are that, as to past loans and future liabilities, the said borough, and its ratepayers, and their rateable property, shall be upon the same footing as other local bodies included in the said district, and their ratepayers, and the rateable property of such ratepayers.

That, as to representation, the said borough shall be incorporated with and be entitled to be represented until the next election of members of the Board, and thereafter in all future elections of members, together with and as if it were part of the Makikihi District; and that for the purposes of all such elections there shall be incorporated with the electoral roll of the said district by the Clerk of the County of Waimate, or other the person whose duty it is to make the same up, the electoral roll for the time being in force in the said borough for the purposes of elections under the law for the time being in operation relating to the election of the Mayor and Councillors of the said borough, and the roll of the said district, as described in "The Timaru Harbour Board Act, 1882."

That it shall be the duty of the Town Clerk of the said borough from time to time, for the purposes of each election, to supply to the County Clerk of the County of Waimate, or such other person as aforesaid, correct copies of the district electors roll of the borough for the time being in force.

That the costs of and incidental to the said inquiry are hereby fixed and directed to be borne as follows:
(a.) There shall be paid and borne by the Timaru Harbour Board the sum of one hundred pounds (£100) for the costs of the hearing.
(b.) That there shall be paid to the Colonial Secretary the sum of fifty pounds (£50), to be borne equally by the said parties, as the remuneration and expenses of the Commissioners.
(c.) It shall be a sufficient compliance with this paragraph of this decision if the Timaru Harbour Board remits to each of the said Commissioners the sum of twenty-five pounds (£25) and pays to the Treasurer of the said borough the sum of seventy-five pounds (£75).

PAHIATUA COUNTY COUNCIL.
Special Order striking Special Rate.--Loan 76.
THAT, in pursuance and exercise of the powers vested in it in that behalf by "The Local Bodies' Loans Act, 1901," the Pahiatua County Council hereby resolves as follows: That, for the purpose of providing interest and other charges on a loan of £150, authorised to be raised by the Pahiatua County Council, under the above-named Act, for the erection of a bridge over a creek on the Marima Ridge Road, the said Pahiatua County Council hereby makes and levies a special rate of ½d. in the pound upon the unimproved rateable value of all rateable property in the Marima Ridge Road Special-rating District, comprising the following sections--Sections 4 and 5, Block V; 98, 97, 105, and 104, Block VI; 9, 10, and 11, Block IX; 13, 14, and 19, Block
X; all in the Mangahao Survey District: and that such special rate shall be an annual-recurring rate during the currency of such loan, and be payable on the 1st day of April in each and every year during the currency of such loan, being a period of forty-one years, at 4 per cent. per annum, or until the loan is fully paid off.
I hereby certify that the above special order was duly made and passed at a special meeting of the Pahiatua County Council on the 3rd day of August, 1907, and confirmed at a meeting of the said Council on the 7th day of September, 1907.

Special Order making Special Rate.
PUBLIC notice is hereby given that the following special order, making a special rate to meet the interest and other charges on a loan of £2,500, was duly passed at a special meeting of the Council on the 21st day of January, 1907, viz:
That, in pursuance and exercise of the powers vested in it in that behalf by "The Local Bodies' Loans Act, 1901," the Kawhia County Council hereby resolves as follows: That, for the purpose of providing the interest and other charges on a loan of £2,500 (this is portion of a loan of £12,000 for two successive years' expenditure), authorised to be raised by the Kawhia County Council, under the above-named Act, for the purpose of providing for the widening and metalling of the Awaroa-Mahoe Road, the said loan to be for a period of forty-one years, and that the interest to be paid is at the rate of 4 per centum per annum, the said Kawhia County Council hereby makes and levies a special rate of 2¼d. in the pound upon the rateable value of all rateable property in the Awaroa-Mahoe Special-rating District, comprising all those sections abutting on the Awaroa-Mahoe Road, from Gray's Landing up to Section 5B, Block VIII, and Section 3, Block VIII (inclusive); Section 3, Block XI; Section 3, Block VII; Section 4A, Block VIII; Section 1, Block IV; Section 6, Block XIII; 601 acres Crown land in Block XVI, adjoining Section 6, Block XIII; and Hauturu West Block No. 1A: and that such special rate shall be an annual-recurring rate during the currency of such loan, and shall be payable on the 1st day of April in each and every year during the currency of such loan, being a period of forty-one years, or until such loan is fully paid off.
