Native Lands proposed to be taken for a Cemetery in Tokomaru Survey District.

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-ninth day of July, 1907.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the lands mentioned in the Schedule hereto are required to be taken for a public work, to wit, for the purpose of a cemetery:

And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-ninth section of “The Public Works Act, 1905”:

Now, therefore, in pursuance and in exercise of the powers vested in him by the eighty-ninth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said cemetery; and the said lands vest in His Majesty the King as from the first day of August, one thousand nine hundred and seven.

Exempting Heaton Terrace, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixteenth day of August, 1907.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose:

And whereas on the eleventh day of June, one thousand nine hundred and seven, the Council of the City of Wellington, the local authority having control of the street known as Heaton Terrace, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre of the said street.

SCHEDULE.

That street known as Heaton Terrace, in the City of Wellington, situated between Washington Avenue and the Town Belt, in the City of Wellington, a distance of about 4½ chains; as the said street is more particularly delineated on the plan marked R. 8886, and deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Exempting Severn Street, Island Bay, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905.”

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution.

SCHEDULE.

That street known as Severn Street, Island Bay, in the City of Wellington and the Wellington Land District, extending from the Esplanade, Island Bay, to a point about 11½ chains past Moselle Street, in the said City of Wellington; as the said street is more particularly delineated on the plan marked R. 8971, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.
