the streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:
And whereas it is deemed expedient that such resolution should be approved, subject to the conditions hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said streets within a distance of thirty-three feet from the centre-line of the said streets in each case.
SCHEDULE.
THAT street in the City of Nelson, Nelson Land District, known as Milton Street, extending from Hardy Street to the city boundary; also that street in the City of Nelson known as Cambria Street, extending from its eastern boundary to Collingwood Street; also that street in the City of Nelson known as Grove Street, in the City of Nelson, extending from its eastern boundary to Collingwood Street, in the said city: as the said streets are more particularly delineated on the plan marked R. 8799, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink:

Exempting Hobson Street, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

At the Government House, at Wellington, this twenty-ninth day of July, 1907.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose:
And whereas on the twelfth day of June, one thousand nine hundred and seven, the Council of the City of Wellington, the local authority having control of the street known as Hobson Street, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

WHEREAS by section one hundred and thirty-three, (a), of “The Public Works Act, 1905,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:
And whereas the Waipawa County Council has applied for such consent in respect to the road described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the closing of the road mentioned in the Schedule hereto.

WHEREAS the Hokianga County Council was, by Order in Council dated the eighteenth day of April, one thousand nine hundred and six, and issued under “The Harbours Act Amendment Act, 1883,” licensed and permitted to use and occupy a part of the foreshore and of the land below low-water mark of the Hokianga River at Horeke, for the purpose of constructing or erecting thereon a wharf, in accordance with plan marked M.D. 2944, which plan was, in pursuance of the provisions of section one hundred and fifty-six of “The Harbours Act, 1878,” approved by the Governor in Council on the said eighteenth day of April, one thousand nine hundred and six: And whereas such wharf has been erected, and it is desirable that dues and rates should be prescribed for the use of the said wharf;
