Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-ninth day of April, in the year of our Lord one thousand nine hundred and seven.

Native Lands taken for the Purposes of a Road in Maungatuna No. 2 and Kopuatarakihī No. 2 Blocks, Uawa Survey District, Cook County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eleventh day of April, 1907.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS the lands mentioned in the Schedule hereto are required to be taken for a public work, to wit, for the purposes of a road in Maungatuna No. 2 and Kopuatarakihī No. 2 Blocks, Uawa Survey District:
And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-ninth section of “The Public Works Act, 1905”:
Now, therefore, in pursuance and in exercise of the powers vested in him by the eighty-ninth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road; and the said lands shall vest in His Majesty the King as from the twenty-eighth day of May, one thousand nine hundred and seven.

Consenting to Land being taken for a Street in the Borough of Hamilton.

At the Government Buildings, at Wellington, this twenty-fourth day of April, 1907.

THE HONOURABLE W. HALL-JONES PRESIDING IN COUNCIL.
WHEREAS by “The Public Works Act, 1905” (hereinafter termed “the said Act”), it is, in section fifteen, (b), thereof, inter alia, enacted that there shall not be taken any land occupied by any building, yard, garden, orchard, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council:
And whereas an application has been made by the Council of the Borough of Hamilton for the issue of an Order in Council under the said section consenting to the taking of a piece of land described in the Schedule hereto, a portion of which is occupied by a garden:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the land described in the Schedule hereto being taken by the said Borough Council for the purposes of a street.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Public Works Act, 1905,” it is, in section ninety-four thereof, enacted that there shall not be taken any land occupied by any pā, village, or cultivation, or any buildings, gardens, orchards, plantations, or any burial or ornamental grounds, without the previous consent of the Governor in Council:
And whereas the consent of the Governor in Council is required to the taking of land for the purpose of a road through the land described in the Schedule hereto, a portion of which is occupied by a Native cultivation:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the land described in the Schedule hereto being taken for the purpose of a road.
