(f.) No water-closet shall be placed in any bathroom, or
in any room or closet used for any other purpose
except as a lavatory, privy, or urinal; and no
person shall hereafter in any manner erect,
make, or establish a water-closet or septic tank
without first obtaining a permit from the Board.
Application for such permit to be accompanied
by a plan of such proposed work and to have
received the approval in writing of the District
Health Officer.

(g.) When, for any reason, any sanitary convenience, or
any portion of a drain, or any fittings in con-
nection therewith are no longer required for use,
such portion of the drain and fittings shall be
disconnected and removed, and any openings or
connections with existing drains and sewers shall
be properly closed and made good.

Privies.

  1. No person shall construct any privy or closet other than
    a water-closet except in accordance with the following pro-
    visions, and the owner and occupier of any premises upon
    which any privy or closet exists shall at any time after two
    months from the coming into force of this by-law cause such
    privy or closet to conform in every respect thereto.

(a.) No part of any privy shall be at less than 15 ft. dis-
tance from any road, street, or footpath, nor from
any dwellinghouse, and from every part of any
wash-house, shed, convenience, or other erection
attached to such dwellinghouse; or from any
building, shop, or office in which any person may
or may be intended to be employed in any manu-
facture, trade, or business other than a detached
wash-house used exclusively for domestic pur-
poses; or from any place of public worship, or any
public hall or school. Every privy shall be so
situated that the pan can be removed and the
contents disposed of without the same having to
be carried through any house, shop, factory, or
workshop.

(b.) Every privy other than a water-closet shall be so
constructed or altered that at least one of its
sides shall be an external wall. The floor, in-
cluding the space under the seat, shall be of good
sound timber, planed, tongued, and grooved, or of
brick or cement, and shall be at least 6 in. above
the level of the ground immediately adjoining
thereto. It shall be properly lighted and venti-
lated, and the door shall be in a position adapted
to conceal the interior from the public view. The
seat shall be capable of being opened or removed
for the entire width for the purpose of cleaning
the space beneath. Battens shall be placed on the
floor beneath the seat so as to secure that the pan
shall be so placed that all excreta shall fall directly
into the pan.

(c.) Every privy shall be provided with a removable
watertight metal receptacle made in accordance
with such model pan or pans as may from time to
time be determined by resolution of the Board,
and deposited at the Board’s office as a pattern
of a “regulation pan,” and approved by the Dis-
trict Health Officer: Provided that if before the
coming into force of this by-law the owner or
occupier has provided a removable watertight re-
ceptacle with at least two handles and of not
greater capacity than 2 cubic feet, it shall not be
compulsory upon the owner or occupier of the
premises to provide the “regulation pan” herein
specified until served with a notice in writing
by the Inspector of Nuisances appointed by the
Board requiring him so to do.

Disposal of nightsoil.

  1. No person shall place or deposit nightsoil in a pit or
    other fixed receptacle in the ground, or spread nightsoil upon
    the surface of the ground, or bury nightsoil within 33 ft. of
    any house, shop, factory, or workshop, or within 20 ft. of
    the boundary of such premises. No person shall dispose of
    nightsoil in any way so as to create a nuisance. No person
    shall bury nightsoil otherwise than in the following manner:
    A V-shaped furrow or trench shall be formed of not more
    than 18 in. in depth, and the nightsoil shall be placed
    along the bottom of such furrow or trench, and covered with
    earth level with the surface and so that the nightsoil shall
    be forthwith covered with at least 6 in. of earth.

Depositing rubbish.

  1. No person shall throw, leave, or deposit upon any road
    or vacant allotment within the district any offensive matter,
    or any bottles, earthenware, china, or rubbish of any de-
    scription.

  2. If any person shall commit a breach of these by-laws he
    shall be liable to a penalty not exceeding £5, and in the case
    of a continuous breach an additional penalty not exceeding
    £5 for every day on which the breach is continued after the
    first day. The continued existence in a state contrary to
    any by-laws of any work or thing shall be deemed a con-
    tinuous breach within the meaning of this section.

  3. These by-laws shall come into force on the 1st day of
    January, 1907, or so soon thereafter as they shall be pub-
    lished in the New Zealand Gazette.

Passed by the Mount Albert Road Board at a special
meeting held on the 26th day of November, 1906, and con-
firmed by special order at a special meeting of the said
Road Board on the 24th day of December, 1906.

Albert District By-law No. 5 (“Building and Overcrowding”)
was made by the Mount Albert Road Board by special
order in accordance with the provisions of “The Road
Boards Act, 1882,” and of “The Public Health Act, 1900,”
and the several amendments to both Ordinances, and that
all the requirements of the law in that behalf have been
duly complied with.
