Validating the Notice of the Poll of Ratepayers in connection with a Loan of £4,000 applied for by the Sefton-Ashley Drainage Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS the Sefton-Ashley Drainage Board has applied to the Colonial Treasurer, under the provisions of “The Local Bodies’ Loans Act, 1901” (hereinafter called “the said Act”), and its amendments, for a loan of four thousand pounds for the purpose of erecting protective works along the River Ashley, three thousand three hundred pounds; Stoney Creek, two hundred pounds; and Fox’s Creek, five hundred pounds: And whereas by section eleven of the said Act it is provided that the Chairman of the local body shall publish a notice setting forth the day on which the poll of ratepayers is to be taken: And whereas the said notice setting forth the date as the fourteenth day of June, one thousand nine hundred and six, upon which a poll of ratepayers would be taken on the proposal to raise the above-mentioned loan was not published in a newspaper, but was instead notified by printed circular sent or posted to each individual ratepayer: And whereas the Governor is satisfied that the ratepayers were not misled by such irregularity, and it appears expedient to validate the said notice of poll:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony and in pursuance and exercise of the powers and authorities contained in the tenth section of “The Local Bodies’ Loans Amendment Act, 1902,” doth hereby validate the said recited notice of poll so sent or posted as aforesaid, and doth hereby declare that all proceedings thereunder shall be and be deemed to have been as good, valid, and effectual as if the said recited notice of poll had been duly and regularly published in terms of the said Act.

Native Lands taken for the Purposes of a Road in Maungatuna No. 2 and Kopuatarakihi No. 2 Blocks, Uawa Survey District, Cook County.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eleventh day of April, 1907.

Present:

His Excellency the Governor in Council.

WHEREAS the lands mentioned in the Schedule hereto are required to be taken for a public work, to wit, for the purposes of a road in Maungatuna No. 2 and Kopuatarakihi No. 2 Blocks, Uawa Survey District:

And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-ninth section of “The Public Works Act, 1905”:

Now, therefore, in pursuance and in exercise of the powers vested in him by the eighty-ninth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road; and the said lands shall vest in His Majesty the King as from the twenty-eighth day of May, one thousand nine hundred and seven.
