Taking the Waimana Estate under “The Land for Settlements Consolidation Act, 1900,” and its Amendments.

A PROCLAMATION.
WHEREAS by a notice published in the New Zealand Gazette of the twenty-sixth day of April, one thousand nine hundred and six, it was therein stated that it was the intention of the Governor to take compulsorily, under the powers in that behalf conferred by “The Land for Settlements Consolidation Act, 1900,” and its amendments, the lands mentioned in such notice:
And whereas, in pursuance of such notice, a claim for compensation was made by the Assets Realisation Board, and the claim has been determined by the Compensation Court sitting at Rotorua, in the Provincial District of Auckland, in manner provided by such Acts:
And whereas, in pursuance of the said Acts, an order was made by the said Court on the tenth day of January, one thousand nine hundred and seven, declaring the land which the Minister is entitled to take (being identical with the land specified in the Schedule hereto), and also declaring the amount of compensation and costs to be paid in respect to the taking of such land, which order is now duly filed in the office of the Supreme Court, Auckland:
Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the said Acts, and of all other powers and authorities in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto (being identical with the land specified in the aforesaid order) is compulsorily taken under the said Acts, as from the first day of April, one thousand nine hundred and seven.
SCHEDULE.
WAIMANA ESTATE.
Acreage and Description.—All that parcel of land in the Auckland Land District, situated in Blocks II, III, and IV, Waimana Survey District, being Waimana No. 1a Block, containing by admeasurement 4,623 acres 3 roods 22 perches, more or less, exclusive of the area contained in Sections 17 and 18 of the Waimana Estate, and also exclusive of all roads now laid out through the said estate. Bounded towards the north by Section 7, Block II, Waimana Survey District (Opouriao Settlement), and Section 5, a subdivision of Section 307 of the Parish of Waimana. 9082·8 links; thence by Section 5 aforesaid and Sections 6, 7, 8, 9, 10, and 11, all subdivisions of the aforesaid Section 307, Parish of Waimana, and by Sections 220 and 221 of the Parish of Waimana aforesaid, 22854·4 links; thence towards the east, north, and west by Waimana No. 1e Block, 8545·2, 7849, and 7639·2 links; again towards the north by Section 269, Parish of Waiotahi, 1082 links; towards the north-east by Tahoma No. 2æ No. 3 Block, 6019·5 links; towards the south-east by the aforesaid Tahoma No. 2æ No. 3 Block, 6019·5 links; towards the south-east by the aforesaid Tahoma No. 2æ No. 3 Block and by Tahoma No. 2æ No. 3 Section 1 Block, 7907·5 links; thence by Tahoma No. 2æ No. 2 Block, 2060·6 links; towards the south by Waimana No. 1c Block, 14848·6 links; towards the west by Waimana No. 1b Block, 200, 550, 1120, 2230, 480, 570, and 1498 links; again towards the south and east by the aforesaid Waimana No. 1b Block, 8039·7 and 5954·6 links; again towards the south by the aforesaid Waimana No. 1c Block, 17615 links; towards the west by the Ruatoki Block, 5937·2, 9116·3, 886, and 410·9 links: be all the aforesaid linkages more or less: but excluding from the aforesaid description Sections 17 and 18 of the Waimana Estate aforesaid, containing together 118 acres 3 roods 32 perches, more or less: as the same is delineated on Plan No. 19333, deposited in the Head Office of the Lands and Survey Department, at Wellington, and thereon edged with red.
Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this sixteenth day of February, in the year of our Lord one thousand nine hundred and seven.
