and after the date hereof, that part of the said colony described in the Schedule hereto shall be and the same is hereby constituted a district under the said Act, and shall be known by the name of the Kahutara River District; and that the number of members who are to constitute the Board of the said district shall be five. And I do also proclaim and declare that Charles John Kent Johnston, of Featherston, shall be the Returning Officer to conduct the first election of five members of the aforesaid Board; that Thursday, the seventh day of March, one thousand nine hundred and seven, shall be the day, and the office of the Featherston Town Board, at Featherston, shall be the place, for holding such first election; and that Thursday, the fourteenth day of March, one thousand nine hundred and seven, at eleven o’clock in the forenoon, shall be the time, and the said office of the Featherston Town Board, at Featherston, shall be the place, at which the first meeting of the members of the Board of the said Kahutara River District shall be held; and lastly, I do proclaim and declare that the aforesaid Charles John Kent Johnston shall be the person to make a roll of electors for the purposes of the aforesaid first election, in the manner prescribed by section eight of the said “River Boards Act, 1884.”

SCHEDULE.
KAHUTARA RIVER DISTRICT.
All that area in the Wellington Land District bounded towards the north-east by the Mangatete Stream from Lake Wairarapa to Section No. 1, Block XI, Wairarapa Survey District; thence by that section to its southernmost corner; thence towards the south-east by Section No. 1 of Te Awaawaroa No. 1 Block, and the Whakawerawera Stream to Burt’s Road; thence towards the south-west generally by Burt’s Road to Kahutara Road; thence by Kahutara Road to the Opoura Stream; thence by the Opoura Stream to Lake Wairarapa; and thence towards the north-west by the said Lake Wairarapa.
Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this seventh day of February, in the year of our Lord one thousand nine hundred and seven.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of January, 1907.
Present:
THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the land mentioned in the Schedule hereto is required for a certain public work, to wit, a Native school:
And whereas the Native owners have agreed to make a free gift of the said land to His Majesty the King, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:
And whereas by certificate of title, Vol. 75, folio 278, of the Register-book of the Auckland District, bearing date the twenty-fourth day of July, one thousand eight hundred and ninety-five, certain aboriginal Natives are declared to be the owners of Lot 63, Parish of Waipa, within which the said land is situated:
And whereas, as required by “The Public Works Acts Compilation Act, 1905,” a map has been prepared showing accurately the position and extent of the said land, and such map is hereto attached:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Acts Compilation Act, 1905,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the land shown upon the said map and described in the Schedule hereto is hereby taken for the purposes of the said Native school, and shall vest in His Majesty the King, as from the fourth day of March, one thousand nine hundred and seven.

WHEREAS the lands mentioned in the Schedule hereto are required to be taken for a public work, to wit, for the purpose of a road in Kawhia P. Block, Block IX, Kawhia Survey District:
And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-ninth section of “The Public Works Act, 1905”:
Now, therefore, in pursuance and in exercise of the powers vested in him by the eighty-ninth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road, and the said lands vest in His Majesty the King, as from the eighth day of March, one thousand nine hundred and seven.
