Empowering Native Appellate Court to hear Appeal under Section 62 of “The Native Land Laws Amendment Act, 1895.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-second day of October, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section sixty-two of “The Native Land Laws Amendment Act, 1895,” it is provided that in any case in which application has been or shall be made to the Chief Judge of the Native Land Court, under section thirty-nine of “The Native Land Court Act, 1894,” in respect of any order of the Court determining the succession to the estate of any Native deceased, the Governor, on being certified by the Chief Judge as in the said section is provided, may, by Order in Council, empower the Native Appellate Court to deal with such application as a valid appeal under “The Native Land Court Act, 1894”: And whereas the Chief Judge has, in respect of the application of Paora T·retiu and Rangikauhata te Waonui, under section thirty-nine aforesaid, certified as by the said section sixty-two is required: And whereas the said application in all other respects complies with the requirements of the last-mentioned section:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby empower the Native Appellate Court to deal with the said application as an appeal, under the provisions of “The Native Land Court Act, 1894,” from the orders of Court hereinafter specified, that is to say.—

The two orders of the Court, dated the sixteenth day of February, one thousand nine hundred and five, appointing Mere Makirangi to succeed to the interests of Hori Tamati Rawakore, otherwise known as Hori Ihaka te Rou, deceased, in the undermentioned blocks of land, viz.: Te Aro Pa, Lot 21; Hutt, Section 19, Subdivision 1.

Domain Board appointed to have Control of the Kaiapoi Domain.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-second day of October, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by “The Public Domains Act, 1881,” and the amendments thereof (including “The Domain Boards Act, 1904”), His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke a certain Order in Council, dated the tenth day of November, one thousand nine hundred and three, delegating powers to the Kaiapoi Domain Board, and doth hereby appoint

THE KAIAPOI BOROUGH COUNCIL

to be the Kaiapoi Domain Board, having, subject to the said Acts, control of the lands described in the Schedule hereto, which lands are a public domain, and shall be called the Kaiapoi Domain; and also doth hereby appoint Tuesday, the thirteenth day of November, one thousand nine hundred and six, at eight o’clock p.m., as the time when, and the Council Chambers, Kaiapoi, as the place where, the first meeting of the said Board shall be held.


SCHEDULE.

KAIAP0I DOMAIN.

All that area in the Canterbury Land District, containing by admeasurement 15 acres and 32 perches, more or less, being Reserve No. 74, situated in Block XV, Rangiora Survey District. Bounded towards the north and east by Section No. 1289; towards the south by Section No. 338E; and towards the west by the Old North Road: as the same is delineated on the plan marked L. and S. 25226, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Also all that area in the Canterbury Land District, containing 122 acres, more or less, being Reserve No. 3658, and formerly part of Reserve No. 1579, situated in Block XVI, Rangiora Survey District. Bounded towards the north-west by a line in continuation of the north-western boundary of Rural Section No. 9560 to a point distant about 20 chains from the sea-coast; thence southerly by a line averaging about 20 chains distant and parallel to the sea-coast to a point on the road reserved along the northern bank of the River Waimakariri; thence westerly along the said road to the Saltwater Creek; thence northerly along the said creek to the commencing-point: as the same is delineated upon the plan marked L. and S. 25226A, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Also all that area in the Canterbury Land District, containing by admeasurement 138 acres, more or less, being Reserve No. 3731 (formerly portion of Reserve No. 1579), situated in Blocks XII and XVI, Rangiora Survey District. Bounded towards the north by the road forming the southern boundary of Reserve No. 3728; towards the east by the Beach Reserve, 2000 links distant from the high-water mark of the ocean; towards the south by Reserve No. 3658; and towards the west generally by the Saltwater Creek, the south-east and north-east boundaries of Section No. 13686, road-lines forming north-west boundary of same, and north-east boundaries of Sections Nos. 22535 and 22534, also by the south-west and south-east boundaries of Section No. 11323 (11361) to the commencing-point: as the same is more particularly delineated on the plan marked L. and S. 25226B, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Declaring Omahine Road, in Wairoa Road District, to be a District Road.

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-second day of October, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a district road.


SCHEDULE.

OMAHINE ROAD.

That part of the Omahine Road, in the County of Patea and in the Wellington Land District, from its junction with the Moturoa Road in a general north-easterly direction for 101 chains, or thereabouts, through Section 11, Block IV, Omahine Survey District, to the point where the road first enters Section 3, Block XVI, Opaku Survey District; as the same is more particularly delineated on plan marked R. 4912, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.
