Special Order made by the Avondale Road Board, County of Eden, making By-laws.

THE following special order, made by the Avondale Road Board, is published in accordance with the provisions of "The Road Boards Act, 1882."

AVONDALE ROAD DISTRICT.
A By-law of the Inhabitants of the Avondale Road District made by Special Order of the Avondale Road Board passed at a Special Meeting of the said Road Board held on the 4th day of August, 1906, and confirmed at a subsequent Meeting of the said Road Board held on the 8th day of September, 1906.
WHEREAS the Avondale Road District is situated within the County of Eden: And whereas "The Counties Act, 1886," provides, inter alia, that the County of Eden shall be deemed to be a county wherein such last-mentioned Act is suspended, and that the various Road Boards in any county in which the said Act is suspended shall within their respective districts have and may exercise all the powers and perform the functions and discharge the duties which at the time of the suspension of the said Act were vested in and imposed upon the Council unless otherwise provided by the said Act or any other Act then or thereafter to be passed: And whereas the Avondale Road Board is of opinion that the conduct of the traffic mentioned in clause 6 of this by-law will cause serious injury to the roads under its control: And whereas it is expedient to make by-laws for the purposes hereinafter mentioned:
Now, the Avondale Road Board, in pursuance of the powers conferred upon it by "The Road Boards Act, 1882," and its amendments, "The Counties Act, 1886," and its amendments, and "The Public Works Act, 1905," and of every power thereunto enabling it, hereby ordains as follows:-
- In this by-law, unless inconsistent with the context, "heavy traffic" means,-
(a.) The transportation of any vehicle, engine, or machine which itself or together with any thing or things being transported thereon weighs more than one and a half tons avoirdupois to each pair of wheels.
(b.) The traction of any vehicle or thing by means of bullocks, notwithstanding that such vehicle or thing may separately or together with any load thereon weigh less than one and a half tons avoirdupois.
(c.) Any traffic which may from time to time be declared to be "heavy traffic" by Order in Council.

No person or persons, company or companies, corporation or corporations, shall during the months of May, June, July, August, and September in any year take, draw, carry, or transport, or cause to be taken, drawn, carried, or transported, and no person or persons, company or companies, corporation or corporations, shall during any of the said months engage in, any heavy traffic upon or along any road, bridge, ferry, or ford under the care, control, or management of the Avondale Road Board and within the Avondale Road District.

The penalty for any breach of clause 2 hereof shall be a sum not exceeding £5.

No person shall drive or conduct any vehicle or machine save buggies and gigs upon or along any road, bridge, ferry, or ford under the care, control, or management of the Avondale Road Board and within the Avondale Road District, unless such vehicle or machine shall have marked thereon in conspicuous position and in a plain and legible manner the weight of such vehicle or machine; and any person who commits a breach of this clause of this by-law shall be liable to a fine not exceeding £20.

For the purpose of computing the weight of the contents of any vehicle or machine engaged in heavy traffic, a measured ton of firewood shall be deemed to be 14 cwt.; 500 ft. of superficial sawn kauri shall be deemed to be 15 cwt.; 63 cubic feet of kauri shall be deemed to be one ton; 40 cubic feet of rimu, puriri, green totara, or kahikatea shall be deemed to be one ton; 13 cubic feet of solid stone shall be deemed to be one ton; 25 cubic feet of earth shall be deemed to be one ton; 22 cubic feet of clay shall be deemed to be one ton; 27 cubic feet of scoria shall be deemed to be one ton; 22 cubic feet of gravel or sand shall be deemed to be one ton; 20 cubic feet of broken road-metal shall be deemed to be one ton; 19 cubic feet of bricks shall be deemed to be one ton; 48 cubic feet of coal shall be deemed to be one ton; and 25 cubic feet of kauri-gum shall be deemed to be one ton; and so in proportion as any of the said respective several substances or things shall exceed the said measurements respectively.

No person or persons, company or companies, corporation or corporations, shall conduct or cause to be conducted all or any of the following kinds of traffic - that is to say, the carriage of water-pipes, collars for water-pipes, lead, metal elbows, gas-pipes, stone, and scoria - upon or along any road under the control of the Avondale Road Board, unless the cost as estimated by the said Road Board of reinstating the road or roads consequent upon the injury to be occasioned by such traffic upon or along which such traffic is to be conducted is previously paid to it.

No person shall drive, lead, or conduct any vehicle, contrivance, or machine containing or having thereon any water-pipes, collars for water-pipes, lead, metal elbows, gas-pipes, stone, or scoria upon or along any of the said roads, unless the cost as estimated by the said Road Board of reinstating the road or roads consequent upon the injury to be occasioned by such traffic upon or along which such traffic is to be conducted is previously paid to it.

For the purpose of ascertaining the cost of reinstating the road or roads upon or along which such traffic is to be conducted, any person or persons, company or companies, corporation or corporations, desirous of conducting such traffic upon or along any such road or roads may make an application in the form of the Schedule hereto to the said Road Board.
