Setting apart Land under “The Workers’ Dwellings Act, 1905.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of September, 1906.

Present:

His Excellency the Governor in Council.

IN exercise and pursuance of the power and authority vested in me by section three of “The Workers’ Dwellings Act, 1905,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, do hereby set apart the land described in the Schedule hereto for the purposes of “The Workers’ Dwellings Act, 1905,” and its amendment, the said land being Crown land.

SCHEDULE.

All that area in the Wellington Land District, containing by admeasurement 2 roods 24·8 perches, more or less, being part of Section No. 817, City of Wellington. Bounded towards the north-east by the Town Belt; towards the south-east by Section No. 818; towards the south-west by Coromandel Street; and towards the north-west by Seddon Terrace and Section No. 816: as the same is delineated on the plan marked L. and S. 19364, deposited in the Head Office, Department of Lands, Wellington, and thereon bordered red.

Declaring that the Kawhia County Council shall exercise the Powers of a Harbour Board in Kawhia Harbour, and defining the Limits of such Harbour.

At the Government House, at Wellington, this third day of September, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS it is among other things provided by section two hundred and forty-two of “The Counties Act, 1886,” that, in any place where there is no Harbour Board, the Governor, on the request of the Council of any county bordering on any estuary or arm of the sea, may, by Order in Council duly gazetted, declare that such Council shall, from a date to be fixed in such Order, exercise all the powers of a Harbour Board within such limits of such estuary or arm aforesaid as the Governor may define for that purpose:

And whereas the Council of the County of Kawhia, which borders on the estuary or arm of the sea known as Kawhia Harbour, in the Provincial District of Auckland, has requested that it may be declared that it shall exercise all the powers of a Harbour Board within that estuary or arm of the sea:

And whereas it is desirable that such request should be acceded to, and that the limits of such estuary or arm of the sea should be defined as hereinafter appears:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that, from and after the first day of October, one thousand nine hundred and six, the said Council shall exercise all the powers of a Harbour Board within the limits of the estuary or arm of the sea hereinafter set forth, and which said estuary or arm of the sea is called Kawhia Harbour:

And in further pursuance and exercise of the hereinbefore-recited power and authority, His Excellency, with the advice and consent aforesaid, doth hereby define the limits of the said estuary or arm of the sea within which the Council of the County of Kawhia is to exercise the powers aforesaid as follows, that is to say:—

All that area in the Auckland Land District bounded as follows: Commencing at a point on high-water mark on the western boundary of Kawhia F No. 2, or Ngairo, Block V, Kawhia North Survey District, the said point being distant two nautical miles from Tauratahi Hill, on the southernmost extremity of Maketu No. 6096B; proceeding thence in a southerly direction along high-water mark to the entrance to Kawhia Harbour; thence along the high-water mark of Kawhia Harbour, bounding lands in Blocks IX, X, VI, VII, XI, XV, and XIV, Kawhia North Survey District; Blocks II and I, Kawhia South Survey District; Block XIII, Kawhia North Survey District; Block XVI, Albatross Survey District; Blocks XIII and IX, Kawhia North Survey District, to the northernmost extremity of Parawai Native Township at the mouth of Kawhia Harbour; thence to a point on the western boundary of said Parawai Township, distant two nautical miles from the before-mentioned Tauratahi Hill; thence to seaward along the arc of a circle described by a radius of two nautical miles from said Tauratahi Hill to the commencing point: including such areas of all streams and their tributaries discharging into the above-described area as are covered by the tidal waters of the sea at high water of ordinary spring tides: the said area being coloured red on the plan marked M.D. 2992, deposited in the office of the Marine Department, at Wellington.

Increasing the Holding-area of Land to Settlers in the Upper Makuri Village Settlement, Wellington Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of September, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS by an Order in Council issued on the twenty-ninth day of October, one thousand eight hundred and ninety-four, under the authority of the one-hundred-and-sixty-ninth section of “The Land Act, 1892,” fixing the terms and conditions upon which lands in the Upper Makuri Village Settlement, Wellington Land District, should be disposed of, it was provided that no lessee should hold more than one allotment in the said village settlement:

And whereas by an Order in Council issued on the twelfth day of March, one thousand nine hundred and one, it was provided that any settler in the said village settlement could apply for and acquire two allotments therein:

And whereas it is expedient to allow one person to hold more than two allotments in the said Upper Makuri Village Settlement, provided the total area so acquired does not exceed fifty acres:

Now, therefore, His Excellency the Governor, in pursuance of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby cancel and revoke the Order in Council of the twelfth day of March, one thousand nine hundred and one, and amend the Order in Council of the twenty-ninth day of October, one thousand eight hundred and ninety-four, in so far as it affects the number of allotments that may be held in the Upper Makuri Village Settlement, and doth by this present Order declare that on and after the date hereof any settler may apply for and acquire more than two allotments therein, provided that the total area acquired does not exceed fifty acres. And it is hereby further declared that all the provisions of the Order in Council of the twenty-ninth day of October, one thousand eight hundred and ninety-four, aforesaid, shall apply, except as regards the number of allotments that may be held, to the Upper Makuri Village Settlement aforesaid.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

At the Government House, at Wellington, this third day of September, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the
