Closing a Government Road, Waipakura Survey District,
Mangawhero Road District.

A PROCLAMATION.

WHEREAS by section one hundred and thirty-three,
(c). of “The Public Works Act, 1905,” it is enacted
that the Governor may, by Proclamation publicly notified,
stop or alter the course of any Government road or any
part thereof:

And whereas the Government road described in the
Schedule hereto is no longer required for the purpose of
a road in Block XIV, Waipakura Survey District:

Now, therefore, I, William Lee, Baron Plunket, the
Governor of the Colony of New Zealand, in exercise of the
above-in-part-recited Act, and of all other powers in any-
wise enabling me in this behalf, do hereby proclaim as
stopped the road in Block XIV, Waipakura Survey District,
hereinafter described.

SCHEDULE.

A. R. P. 2 2 32 Upoko-ngaro No. 1 XIV Waipakura R. 823A Green.

In the Wellington Land District; as the same is more
particularly delineated on the plan marked and coloured as
above mentioned, and deposited in the office of the Chief
Engineer of Roads, at Wellington, in the Wellington Land
District.

Given under the hand of His Excellency the Right
Honourable William Lee, Baron Plunket, Knight
Commander of the Most Distinguished Order
of Saint Michael and Saint George, Knight
Commander of the Royal Victorian Order, Go-
vernor and Commander-in-Chief in and over His
Majesty’s Colony of New Zealand and its De-
pendencies; and issued under the Seal of the said
Colony, at the Government House, at Wellington,
this thirty-first day of August, in the year of
our Lord one thousand nine hundred and six.

Resuming Land held under Occupation-with-right-of-purchase
License for Scenery-preservation Purposes.

A PROCLAMATION.

WHEREAS by section one hundred and twenty-five of
“ The Land Act, 1892 ” (hereinafter termed “ the
said Act ”), it is, inter alia, enacted that the Governor in
Council may, by Proclamation, resume possession of any
land leased under Part III of the said Act which in his
opinion is required for any public purpose:

And whereas the land described in the Schedule hereto
is held under occupation-with-right-of-purchase license
from His Majesty the King under Part III of the said
Act: And whereas in the opinion of the Governor the land
described in the Schedule hereto is required for a public
purpose—that is to say, for scenery-preservation purposes:

Now, therefore, in pursuance and exercise of the powers
and authorities conferred upon me by section one hundred
and twenty-five of “ The Land Act, 1892, ” and of all other
powers and authorities in anywise enabling me in that behalf,
I, William Lee, Baron Plunket, the Governor of the Colony
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said colony, do hereby pro-
claim and declare that I hereby resume possession of the
land mentioned in the Schedule hereto for the public
purpose hereinbefore mentioned, the same being held under
license as aforesaid; and do also hereby proclaim and
declare that this Proclamation shall take effect on the sixth
day of September, one thousand nine hundred and six.

In the Auckland Land District; as the same is delineated
on the plan deposited in the Head Office, Department of
Lands, at Wellington, and thereon coloured as above stated.

Tram-line across Estuary from Otatara to Invercargill.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day
of September, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Governor in Council did, on the
thirtieth day of April, one thousand nine hundred
and six, approve of plan marked M.D. 2942 of a tram-line
which the Invercargill Borough Council (hereinafter called
“ the Council ”) proposed to construct across the New
River Estuary from Otatara to Invercargill, and did
authorise the Council to construct the said tram-line:

And whereas it is desirable that the said Order in Coun-
cil and the approval and authority thereby conferred
should be revoked and determined, and that another plan
should be approved, and that the construction of the tram-
line in accordance therewith should be authorised:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in exercise of the power and authority con-
ferred upon him by “ The Harbours Act, 1878, ” and of all
other powers and authorities enabling him in that behalf,
and acting by and with the advice and consent of the
Executive Council of the said colony, doth hereby revoke
and determine the said Order in Council of the thirtieth
day of April, one thousand nine hundred and six, and every
right and privilege thereby conferred; and doth hereby
approve of plan marked M.D. 2995, in duplicate, showing
a tram-line across the said estuary and the place where it
is to be constructed; and doth authorise and license the
Council to construct the said tram-line in accordance with
such plan, and to use and occupy such part of the foreshore,
tidal land, and tidal water necessary therefor, subject to the
following terms and conditions, that is to say:—

  1. The tram-line shall be for the use and benefit of the
    public.

  2. The Council may make such charge for the use of the
    tram-line as may be approved by the Minister of Marine.

  3. The rights, powers, and privileges conferred by the
    Order in Council shall continue in force for fourteen years,
    computed from the date thereof; and the Council shall not
    assign, charge, or part with any such right, power, or privi-
    lege without the previous written consent of the Minister
    of Marine first obtained.

  4. The Council shall be liable for any damage or injury
    which the tram-line may cause to any person through any
    negligence or default on its part.
