✨ Road and Loan Notices

APRIL 26.] THE NEW ZEALAND GAZETTE. 1101

Validating the Public Notification of the Meeting of the Rate-
payers, and also the Date of such Meeting, on the Proposal
to raise a Loan of Β£350 to construct Waihoanga Bridge,
applied for by the Te Horo Road Board.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this ninth
day of April, 1906.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN
COUNCIL.

WHEREAS the Te Horo Road Board lately proposed
to raise a loan of three hundred and fifty
pounds, under "'The Local Bodies' Loans Act, 1901,"'
for the construction of Waihoanga Bridge: And whereas
certain irregularities have occurred in the procedure
to obtain such loan, inasmuch as there was a lapse of
five days instead of seven days between the public notification of the meeting of the ratepayers held to consider
the proposal and the date of such meeting, and there was
also an interval of twelve days instead of ten days between
the last public notification to raise the said loan and the date
of the meeting of ratepayers, which is in contravention of
the provisions of section nine of "'The Local Bodies' Loans
Act, 1901"': And whereas it appears that the ratepayers
have not been misled, and it is expedient to validate such
irregularities.

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
power conferred by section ten of "'The Local Bodies'
Loans Amendment Act, 1902,'" and acting by and with the
advice and consent of the Executive Council of the said
colony, doth hereby order and declare that the public
notification of the meeting of the ratepayers and the date of
such meetings shall be deemed and taken to be as valid as
though the said steps had been properly taken, and that the
proceedings relative to the said loan shall not be called in
question by reason only of the irregularities aforesaid.

Acting Clerk of the Executive Council.
