Changing the Purpose of a Portion of a Reserve in the Marlborough Land District.
PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this seventeenth day of February, 1906.
Present:
The Right Honourable R. J. Seddon presiding in Council.
WHEREAS the land described in the Schedule hereto forms part of a reserve heretofore set apart as a site for a town or village, being a reserve within Class I of “The Public Reserves Act, 1881”:
And whereas it is expedient that such land shall be appropriated for scenic purposes, being a reserve within the said Class I:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that the said land shall, from and after the date hereof, be appropriated for scenic purposes under Class I of “The Public Reserves Act, 1881.”
SCHEDULE.
All that area in the Marlborough Land District, containing by admeasurement 22 acres 2 roods, more or less, being part of Reserve No. 73, Block VIII, Heringa Survey District. Bounded towards the north by a public road a distance of 174·8 links; towards the east by a public road a distance of 2889·1 links; towards the south by a public road a distance of 1548·4 links; towards the south-west by part 2 of Section No. 26, Block VIII, Heringa Survey District; and towards the north-west by a public road a distance of 3562·4 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked L. and S. 54877/1, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red.

Exempting Burgoynе and Arney Streets, in the City of Auckland, from the Provisions of Section 117 of “The Public Works Act, 1905.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this seventeenth day of February, 1906.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas on the twenty-first day of December, one thousand nine hundred and five, the Council of the City of Auckland, the local authority having control of Burgoynе Street and Arney Street (being the streets described in the Schedule hereto) did by resolution declare that the provisions of section one hundred and seventeen should not apply to the said streets: And whereas such resolution was in the following terms:
“That the Auckland City Council, having control of Burgoynе Street and Arney Street, both in the City of Auckland, in pursuance of subsection (1) of section 117 of ‘The Public Works Act, 1905,’ doth hereby resolve that the said subsection shall not apply to those portions of the said streets known as Burgoynе and Arney Streets, in the City of Auckland, to which Lot 4 of a subdivision of Allotment 12 of Section 7 of the Suburbs of Auckland has a frontage”:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution.
SCHEDULE.
That portion of Burgoynе Street, in the City of Auckland, abutting on Sections 107, 80, 79, and part of 78. Also that portion of Arney Street, in the City of Auckland, abutting on Sections 21, 22, 23, 24, and part of 25, and part of Sections 78 and 77; as the said streets are more particularly delineated on the plan marked R. 5653, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Exempting Portion of Oriental Terrace, in the City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905.”

At the Government House, at Wellington, this twenty-seventh day of February, 1906.

His Excellency the Governor in Council.
WHEREAS by section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas on the eleventh day of January, one thousand nine hundred and six, the Council of the City of Wellington, the local authority having control of the public street known as Oriental Terrace (being the street described in the Schedule hereto) did by resolution declare that the provisions of the said section should not apply to the said street: And whereas such resolution was in the following terms: “The Council of the City of Wellington hereby resolves that the provisions of section one hundred and seventeen of ‘The Public Works Act, 1905,’ shall not apply to the portion of Oriental Terrace fronting Section 391, belonging to the Wellington Diocesan Board of Trustees, and that a copy of this resolution be forwarded to His Excellency the Governor for approval”:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve the said resolution.
SCHEDULE.
That portion of a public street fronting Section 391, and known as Oriental Terrace, in the City of Wellington; as the said street is more particularly delineated on the plan marked R. 7517, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

At the Government Buildings, at Wellington, this seventeenth day of February, 1906.

The Right Honourable R. J. Seddon presiding in Council.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the road in Waipawa County described in the Schedule below shall, on and after the date of this Order in Council, be a county road.
