Declaring Road known as Black Hill Road, Whernside Survey District, Awatere Road District, to be a District Road.

ORDER IN COUNCIL.
At the Government House, at Wellington, this third day of December, 1906.

His Excellency the Governor in Council.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the road described in the Schedule hereto, known as the Black Hill Road, shall, on and after the date of this Order in Council, be a district road.
SCHEDULE.
BLACK HILL ROAD.
ALL that portion of Black Hill Road Deviation, in the Marlborough Land District, commencing at a point about 10 chains south-west of Section 2, Block XII, Cape Campbell Survey District, and extending in a westerly direction in Section 1, Block X, Whernside Survey District, for a distance of about 7 chains, and from thence in a south-westerly direction for about 16 chains to its junction with existing road; as the same is more particularly delineated on the plan marked R. 1339, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured red, and lettered A.B.

Declaring Roads in Ngarua, Mangawhara, and Maukoro Blocks, in the Ohinemuri County, to be County Roads.

At the Government House, at Wellington, this third day of December, 1906.

His Excellency the Governor in Council.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1905,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the roads in the Ohinemuri County described in the Schedule hereto shall, on and after the date of this Order in Council, be county roads.
SCHEDULE.
ALL that road in the Auckland Land District, situated in the Ohinemuri County, commencing at a point on the southern boundary of Willis’s grant, and thence proceeding generally in a northern direction through the said grant and Sections 7, 6, 5, and 4, Block IX, Hapuakohe Survey District, and thence north along the eastern boundaries of Sections 29, 28, 20, 19, 18, 17, 16, and 15 of Block V, Hapuakohe Survey District, to the north-eastern corner of Section 14, Block I, Hapuakohe Survey District, a distance of 5 miles 60 chains, or thereabouts.
Also all that road commencing at a point on the south-western boundary of Ngarua No. 5a Block, and proceeding generally in a south-westerly direction along the eastern boundaries of Sections 6, 7, 8, of Block XII, Piako Survey District, and thence along the eastern and southern boundaries of Section 9, Blocks XII and XVI, Piako Survey District, to its southernmost angle, a distance of 2 miles 76 chains, or thereabouts.
Also all that road commencing at the south-western corner of Section 9, Blocks XII and XVI, Piako Survey District, and proceeding generally in a south-westerly direction along the southern boundaries of Sections 12, 11, and 10, Block XVI, Piako Survey District, to the southernmost point of Section 1 (forest reserve) of Block XV, Piako Survey District, a distance of 2 miles 50 chains, or thereabouts.
As the said roads are delineated on a plan marked R. 8324, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and lettered A.B.E.D. and D.C. respectively

Consenting to closing Part of Burns Street, Township of Quakerfield, Clutha County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this third day of December, 1906.

His Excellency the Governor in Council.
WHEREAS by section one hundred and thirty-three, subsection (a), of “The Public Works Act, 1905,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:
And whereas the Clutha County Council has applied for such consent in respect to the street described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the Clutha County Council closing the street mentioned in the Schedule hereto.

Exempting Hankey Street, Wellington City, from the Provisions of Section 117 of “The Public Works Act, 1905.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this third day of December, 1906.
Present:
His Excellency the Governor in Council.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas the Wellington City Council, the local authority having control of the street described in the Schedule hereto, did by resolution declare that the provisions of section one hundred and seventeen of “The Public Works Act, 1905,” should not apply to the said street: And whereas such resolution was in the following terms: “That the provisions of section one hundred and seventeen of ‘The Public Works Act, 1905,’ shall not apply to Hankey Street, in the said city, and hereby imposes as a condition of such exemption that no part of a dwellinghouse to be hereafter erected on lands having a frontage to such street shall be erected at a less distance than thirty-three feet from the centre of the roadway”:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve the said resolution.
