Rural Lands in Auckland Land District open for Sale or Selection.
PLUNKET, Governor.
IN pursuance and exercise of the powers and authorities conferred upon me by section one hundred and thirty-six of “The Land Act, 1892,” and section two of “The Bush and Swamp Crown Lands Settlement Act, 1903,” I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby declare and provide as follows, that is to say:—

The rural lands enumerated in the Schedule hereto are hereby set apart for disposal by way of sale or selection on and after the twentieth day of September, one thousand nine hundred and five, at the prices specified in the said Schedule.

The said lands may be purchased for cash, or be selected for occupation with right of purchase, or on lease in perpetuity: provided that in the case of lands containing or supposed to contain any metal, mineral, or valuable stone, it shall be selected on lease in perpetuity only, and shall not be purchased for cash.

For the purposes of “The Bush and Swamp Crown Lands Settlement Act, 1903,” the lands enumerated in the said Schedule hereto shall be deemed to be “heavy-bush land.”

No general rate shall be levied or collected by any local authority from the said lands for the period of four years from the date from which in each case respectively such lands are disposed of, and no local authority shall have power to levy or collect any such rate from such lands during such period.

After the first half-year’s rent has been paid by the selector the further instalments of rent payable by him for a period of four years shall not be demanded: provided that if at any time during the first five years of his occupancy the selector disposes of his interest in the land the rent so conceded shall be paid by him in full, and thereupon the Land Board may remit such instalments of rent payable by the incoming tenant, not exceeding in the aggregate the amount of rent previously conceded to the selector, as the Board shall think fit.

Sections Nos. 6, 7, and 8, Block XII., and 3, Block XIII., Rangaunu Survey District, are weighted with £310, £300, £150, and £230, respectively, as valuations for timber.

Warrant apportioning the Cost of Constructing and Maintaining the Boundary-road between the Counties of Opotiki and Whakatane.
PLUNKET, Governor.
WHEREAS by section two hundred and fifty of “The Counties Act, 1886,” it is provided that where a road lies along the boundary of two counties and such road is entirely in one of such counties, then the whole of such road shall be under the control of the county wherein it is included: And whereas it is, inter alia, further provided by the said enactment that in any case mentioned in the said section the Governor may direct what proportionate part of the cost of constructing and maintaining any such road shall be borne by each county, and that any such proportionate part may be recovered in any Court of competent jurisdiction by the County Council, or local authority having charge of such road, from the county or districts liable to pay the same:
And whereas the portions of the boundary-road between the Counties of Opotiki and Whakatane described in the Schedule hereto (the said portions being hereinafter referred to as “the said road”) are within the County of Opotiki: And whereas a dispute has arisen between the Counties of Opotiki and Whakatane as regards the cost of maintaining the said road: And whereas with the view of determining what proportionate part, if any, of the cost of maintaining the said road should be borne by the Counties of Opotiki and Whakatane respectively the Governor appointed a Commissioner to inquire and report to him upon the matter: And whereas such Commissioner reported to the Governor, after due inquiry: And whereas the Governor is of opinion that the said road should be maintained, and that the cost of same should be apportioned, as provided for in the said Act, as hereinafter appears:
Now, therefore, I, William Lee, Baron Plunket, Governor of the Colony of New Zealand, in pursuance and in exercise of the power and authority vested in me by section two hundred and fifty of “The Counties Act, 1886,” and of every other power enabling me in this behalf, do hereby direct that the cost of constructing and maintaining the said road shall be borne by the Opotiki County Council and the Whakatane County Council in equal shares. And I do hereby direct that the contribution required to be made by the Council of the County of Whakatane shall be paid from time to time out of the funds of the said County Council within a period of thirty days after demand in writing made by or on behalf of the Council of the County of Opotiki; and all such payments shall be made from time to time to the Clerk of the Opotiki County Council, for and on account of such County Council.
SCHEDULE.
THAT portion of the boundary-road between the Counties of Opotiki and Whakatane known as the Beach Road, commencing from the sea-beach and proceeding generally south-westerly for a distance of one mile and three-quarters, or thereabouts, to a small stream in Section 245, Auckland University Endowment; as the same is more particularly delineated on plan marked R. 6226, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured red and lettered A.C.
Also that portion of the boundary-road between the Counties of Opotiki and Whakatane commencing at the Nukuhou River and proceeding generally in a southerly direction for a distance of eight miles and a quarter, or thereabouts, to the confiscation boundary-line, and known as the Upper Road; as the same is more particularly delineated on the plan marked R. 6226, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, thereon coloured red and lettered D.B.
