MOUNT ALBERT ROAD DISTRICT.
By-law No. 3 (the Waterworks By-law).
By-law for levying Charges for Water-supply, regulating Ordinary and Extraordinary Supplies, licensing Plumbers, and the like.
MADE in accordance with “The Road Boards Act 1882 Amendment Act, 1888,” and “The Road Boards Acts Amendment Act, 1904,” and with an Order in Council gazetted on the 2nd day of February, 1905, by special order of the Mount Albert Road Board, dated the 6th day of March, 1905, confirmed on the 3rd day of April, 1905, and sealed with the common seal of the body corporate of the inhabitants of the Mount Albert Road District on the 3rd day of April, 1905.
In pursuance of “The Road Boards Act 1882 Amendment Act, 1888,” and “The Road Boards Acts Amendment Act, 1904,” and an Order in Council gazetted on the 2nd day of February, 1905, the Mount Albert Road Board ordains as follows:—
The Board hereby makes and levies the following rates, and declares the following as the conditions upon which the Board will supply water on all rateable properties:—
Explanation of Terms used.
In these by-laws,—
“District” means the Mount Albert Road District as constituted under “The Road Boards Act, 1882”;
“Clerk” means the person for the time holding the office of Clerk of the Mount Albert Road Board;
“Board” means the Board of the Mount Albert Road District;
“Occupier” includes the person for the time being in charge of any property;
“Property” means and includes lands and buildings;
“Ordinary supply” shall mean only water used for strictly domestic purposes, and the Board reserves the right to determine in any case what shall be considered a supply for strictly domestic purposes;
“Extraordinary supply” shall mean water used for any other than purposes of “ordinary supply,” and may be charged extra accordingly;
“Service” shall include the supply-pipe inside the consumer’s boundary.
Ordinary Supply.

Rateable value on the valuation roll not exceeding £12 10s., a rate of 10s. per annum.

Rateable value on the valuation roll exceeding £12 10s. per annum, and not exceeding £30, a rate of 4½ per centum on such value; and 4 per centum per annum on all over that amount.
Maximum charge for domestic supply, £2 10s. per annum.
NON-CONSUMERS’ RATE.
- Upon all rateable property in the said district to which water can be but is not supplied situate within 100 yards from any part of the waterworks constructed by and now vested in the said Road Board, a rate of one-half of the rates above mentioned.
MISCELLANEOUS.

Urinals in hotels and manufacturing establishments (if not supplied by meter), £1 10s. per annum each urinal; if more than three in any one premises, a deduction of 20 per cent. shall be made.

Urinals in private establishments, 15s. per annum each urinal unless supplied by meter.

Baths in hotels, £2 10s. per each bath per annum.

Lodging- and boarding-houses having ten or more bedrooms, £2 per bath per annum.

Lodging- and boarding-houses under ten bedrooms, £1 per annum for each bath.

Application for water shall be made at the office of the Board, and all necessary forms may be obtained there. Persons making application after the 30th April, 1905, for connection with the water-main shall pay to the Board £1 for laying supply-pipe and necessary work in connection therewith to the boundary of the property to be supplied.

Water rates for such supply shall be payable half-yearly in advance; and new applications for service shall be accompanied by the tender of a sum equal to the rate for the broken period of the current half-year, commencing three days after date of application, except the payments be made within two months prior to end of half-year, in which case payment shall be made to the end of the second half-year.

Every person supplied with water from the water-works shall provide such proper taps, stop-cocks, and such other apparatus as the Board requires, and shall keep the same in good repair, so as to prevent the water running to waste; and in default of providing or keeping in repair any such apparatus the Board may stop the supply of water to such person in any manner it thinks fit.

Not more than one house shall be connected or supplied from a service.
Extraordinary Supply.

Manufacturers, nurserymen, and market-gardeners, by meter, at 1s. 6d. per 1,000 gallons; minimum charge, 10,000 gallons, 15s. per quarter.

Supplies by meter or otherwise outside the district to private individuals or outside bodies, to be charged for at such prices as the Board may determine.

Hose for gardens and other purposes (excepting fire-extinguishing purposes), £1 per annum each, or by meter, at the discretion of the Board. No hose-attachment allowed unless paid for at this rate or by meter. All hose when in use must be held in the hand only, and is not allowed to be otherwise used unless the water be supplied by meter or under special written permission of the Board.

At stand-pipes, by meter, of any quantity not exceeding 400 gallons, 2s. 6d.

Stables and grazing-runs, 7s. 6d. per horse per annum for the maximum number of horses kept in such stables or runs, or by meter, at the discretion of the Board.

Cow, mule, or ass, 5s. each per head per annum.

Builders shall be supplied by meter at 2s. 6d. per 1,000 gallons. They shall deposit the cost of the meter, which cost shall be retained as security that the meter is left in good order. No rent shall be charged for the meter. Minimum charge, £1: Provided that in the case of wooden houses the charge shall be 2s. 6d. for each double chimney, 2s. for each single chimney, 1s. 6d. for each washing-copper casing and chimney, and 3d. per cube yard of concrete-work.

Persons or clubs occupying land for recreation purposes, by meter, at 1s. 6d. per 1,000 gallons, with a minimum of 20,000 gallons per annum, paid in advance,

Ordinary meter rate, 1s. 6d. per 1,000 gallons, with a minimum of 5,000 gallons per quarter.

Fee for cutting off and turning on water-supply, 5s. each.

All pipes over ¾in. to be charged the difference of cost.

Exceptional cases for supply of piping outside of streets with mains, in manner as may be decided by the Board.

Rates by meter shall be payable quarterly.

Any consumer using the water shall, on delivery of written notice, have a meter affixed to gauge his supply. Meters shall be fixed in such places as the Board shall direct, and be charged for as mentioned in scale of charges.

Should any meter be out of repair, or cease to register, or register inaccurately, the officer duly appointed by the Board shall estimate the consumption at the average of the previous quarter charged to the consumer, who shall be liable to pay accordingly, and such decision shall be final.

All water-meters must be enclosed in a wooden box, and the keys of both meters and boxes, duly labelled with the name of the owner, must be lodged at the office of the Board. If required by the consumer the box may have a glass front. Locks of meters to be uniform, and supplied by Board at expense of meter-user.
Plumbers.

Competent plumbers may be licensed by the Board to lay pipes and do any work in connection with water-supply on payment of an annual fee of £1 1s. Every such plumber on receiving his license, and making any required deposit, shall sign an agreement binding himself to comply with the conditions contained in the by-laws of the Board relating to himself and to the water-supply and service; and no persons but those duly licensed by the Board shall be allowed to attach or alter any service-pipe, or in any other way interfere with pipes, taps, cocks, meters, or any matters or things connected with the water-supply or service.

Every plumber shall forward a monthly return (on forms supplied to him) of the work he has done, to the Clerk; and, failing to do so, shall be liable to have his license suspended until such return is duly forwarded, and on being convicted of a breach of this by-law shall be liable to the penalty hereinafter provided.

No licensed plumbers shall do any work connected with the water-supply without giving at least one clear day’s notice thereof, and receiving written authority to do such work from the officer appointed by the Board.

Plumbers shall be responsible for all damage done or caused by them in performing any work whatever, either through bad workmanship or inferior material; and in the event of any damage caused through bad workmanship or neglect they shall be liable to have their licenses cancelled without any refund of license fee.
