SPECIAL ORDER OF THE ONE-TREE HILL ROAD BOARD.

By-laws regulating Erection of Buildings not having a Frontage to a Public or Private street, and preventing the Overcrowding of Land with Buildings.

In pursuance and in exercise of the powers conferred by “The Road Boards Act, 1882,” and “The Public Health Amendment Act, 1903,” and by all or any other statutes it thereunto enabling, the One-tree Hill Road Board hereby makes the following by-laws, which shall come into operation upon being gazetted :—

  1. No new dwelling-house shall be erected in the One-tree Hill Road District upon a site of less area than one-quarter of an acre.

  2. No new dwelling-house shall be erected in the One-tree Hill Road District upon a site not having a frontage of at least 66 ft. to a public or private road.

  3. Every person who erects a new dwelling-house in the One-tree Hill Road District shall provide at the side or in the rear thereof an open space, exclusively belonging to such dwelling-house, and of an aggregate area of not less than 600 square feet.

  4. Such open space shall extend throughout the entire width, or, in the alternative, throughout the entire depth of the site, and shall be free from any erection thereon above the level of the ground, and shall be so maintained while the site is occupied by the dwelling-house.

  5. The minimum distance across such open space from every part of the dwelling-house, and from every part of any wash-house, shed, convenience, or other erection attached thereto, shall be as follows :—

(a.) If the height of the dwelling-house does not exceed 15 ft.—15 ft.

(b.) If the height exceeds 15 ft. but does not exceed 25 ft.—20 ft.

(c.) If the height exceeds 25 ft. but does not exceed 35 ft.—25 ft.

(d.) If the height exceeds 35 ft.—30 ft.

  1. For the purposes of these by-laws, where the side boundaries of any site are not of the same length, the mean length of such side boundaries shall be taken as the depth of the site for the purpose of defining the distance across such open space.

  2. The height of a dwelling-house shall, for the purpose of these by-laws, be measured from the average level of the ground immediately adjoining the side or the rear of such dwelling-house, as the case may be, to the level of half the vertical height of the roof, or to the top of the parapet, whichever is the higher.

  3. Where any alteration or addition is made to any dwelling-house (whether erected before the coming into operation of these by-laws or not), the open space attached to such dwelling-house shall not be diminished by such alteration or addition so as to leave a less area than is required by these by-laws to be provided.

  4. The erection of a dwelling-house upon vacant land or upon a site previously occupied by any building, or the re-erection of any dwelling-house pulled down to within 1 ft. of the ground floor, or the conversion into a dwelling-house of any building not originally constructed for human habitation, or the conversion into more than one dwelling-house of a building originally constructed as one dwelling-house only, or an addition or raising of an existing dwelling-house (so far as such addition or raising is concerned), shall be deemed to be the erection of a new dwelling-house within the meaning of these by-laws.

  5. The ground upon which any dwelling-house is erected, together with the whole curtilage thereof enclosed within the boundary fences, walls, or lines of the premises, shall be deemed to be the site of such dwelling-house within the meaning of these by-laws.

B

  1. Every person who, after the coming into operation of these by-laws, shall do or cause to be done or be concerned in doing anything contrary to these by-laws, or any provision therein contained, or who shall omit to do anything required to be done by him, shall be deemed to have committed a breach of these by-laws.

  2. Any person committing a breach of the foregoing by-laws shall be guilty of an offence, and shall be liable to a penalty not exceeding five pounds for every such offence, and in case of a continuous offence to a penalty of not more than five pounds for each day during which such offence continues.

  3. These by-laws shall affect the whole of the One-tree Hill Road District.

The common seal of the Inhabitants of the One-tree Hill Road District was affixed hereto at a special meeting, and by order of the Board of the said district, on the 15th day of March, 1905, in the presence of —

SPREYDON ROAD BOARD, COUNTY OF SELWYN.

SPECIAL ORDER made by the Spreydon Road Board at a Special Meeting held on Monday, the 20th Day of March, 1905.

THE following by-law for regulating the erection and construction of privies, closets, ashpits, the removal of night-soil, and the prevention of nuisances within that part of the Spreydon Road District hereinafter described, and for imposing penalties for the breach of this by-law, be now confirmed and adopted in form of special order :—

BY-LAW OF THE SPREYDON ROAD BOARD.

In pursuance of the powers and authorities contained in “The Public Health Act, 1900,” and in “The Road Boards Act, 1882,” and the Acts amending the same respectively, and of all other powers in that behalf thereunto enabling or otherwise vested in them, the inhabitants of the Spreydon Road District, by the Spreydon Road Board, do hereby make and ordain the following by-law :—

  1. The Short Title of this by-law shall be “By-law No. 1, 1905.”

  2. This by-law shall apply to and shall be in force in that part of the Spreydon Road District described in the Schedule hereto.

  3. In the interpretation of this by-law the following words and phrases shall have the meanings hereby assigned to them unless there is something in the subject-matter or the context inconsistent with such meaning :—

“Spreydon Road District” or “road district” means the Spreydon Road District constituted under “The Road Boards Act, 1882,” and its amendments.

“Road Board” or “Board” means the Spreydon Road Board.

“Inspector” means the clerk or any other person appointed by the Road Board as Inspector of Nuisances for the time being within the said Road District.

“Office” means the office of the Road Board.

“The” or “Such area” means all such part of the Spreydon Road District as is mentioned in the Schedule hereto.
