Taking the Tawaha Estate under “The Land for Settlements Consolidation Act, 1900,” and its Amendments.

A PROCLAMATION.

WHEREAS by a notice published in the New Zealand Gazette of the third day of November, one thousand nine hundred and four, it was therein stated that it was the intention of the Governor to take compulsorily, under the powers in that behalf conferred by “The Land for Settlements Consolidation Act, 1900,” and its amendment, the land mentioned in such notice:

And whereas, in pursuance of such notice, a claim for compensation was made by William Edward Bidwill and Ernest Tancred Dillon Bell, the executors and trustees of the last will of Charles Robert Bidwill, deceased, and the claim has been determined by the Compensation Court sitting at Wellington, in the Provincial District of Wellington, in manner provided by such Acts:

And whereas, in pursuance of the said Acts, an order was made by the said Court on the twenty-fourth day of June, one thousand nine hundred and five (now duly filed in the office of the Supreme Court at Wellington aforesaid), declaring the land which the Minister is entitled to take, being the land specified in the Schedule hereto, and declaring the amount of compensation and costs to be paid in respect to the taking of such land:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance of the power and authority conferred upon me by the said Acts, and of all other powers and authorities in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto (being the land specified in the aforesaid order dated the twenty-fourth day of June, one thousand nine hundred and five) is compulsorily taken under the said Acts.

FIRST SCHEDULE.

TAWAHA SETTLEMENT.

ALL that parcel of land, situate in the Land District of Wellington, containing by admeasurement 3,350 acres, more or less, being part of Sections 19, 20, 36, and 87, Block V., Huangarua Survey District; Sections 103, 104, and part Ngapuki Block, Block IX., Huangarua Survey District; and part of Sections 21, 90, and 91, Block VIII., Wairarapa Survey District, together with right of way over part of Section 91, Moroa Block, being bounded towards the north-west by part of Section 68, Sections 88 and 89, Wards Road, Battersea Road, and the Martinborough Road, the Otakura Stream, Sections 80, 28, 79, and part 78; towards the south-west by part of Section 91; towards the south-east by the Te Maire Road; again towards the south-west by part of Sections 91, 90, 21, and 78N to the Ruamahanga River; again towards the south-east by the Ruamahunga River to Section 36; towards the north-east and south-east by the Otaraiā Road and the Kaitara Road; again towards the north-east by Section B1 and the Tawaha Block to the starting-point: as the same is more particularly delineated on the plan marked S.G. 19309, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon edged with the colour red: excepting thereout the lands described in the Second Schedule hereto, containing by admeasurement 1,000 acres more or less.

SECOND SCHEDULE.

FIRST, all that parcel of land known as the Homestead Block, containing 739 acres, together with all erections and buildings thereon, being all the land comprised in certificate of title, Vol. 103, folio 99.

Second, all that parcel of land, containing 261 acres, more or less, being parts of Sections 36, 103, and 104, Moroa.
