In the matter of “The Companies Act, 1903,” and of AUSTIN WALSH AND CO. (LIMITED).

AT an extraordinary general meeting of the members of Austin Walsh and Co. (Limited), duly convened, and held at the office of the company, situate at Wyndham Street, Auckland, on Tuesday, the 2nd day of August, 1904, the following resolution was passed as an extraordinary resolution:—

“That it has been proved to the satisfaction of the company that it cannot, by reason of its liabilities, continue its business, and that it is advisable to wind up the same, and that the same be wound up accordingly.”

Messrs. JOHN JESSE ODLUM and WILLIAM BEAMISH AUSTIN MORRISON were appointed Liquidators for the purpose of winding up the affairs of the company.

NOTICE is hereby given that a petition for the winding-up of the above-named company by the Supreme Court was, on the sixteenth day of August, one thousand nine hundred and four, presented to His Honour Worley Bassett Edwards, Esquire, a Judge of the Supreme Court of New Zealand, at Auckland, by William Elkin Hutchison, of the City of Auckland, in the Provincial District of Auckland, in New Zealand, Builder and Contractor, a creditor of the said company; and the said petition is directed to be heard before a Judge of the said Supreme Court on Tuesday, the sixth day of September, one thousand nine hundred and four, at the hour of eleven o’clock in the forenoon, or as soon thereafter as counsel can be heard, and any creditor or contributory of the said company desirous to oppose the making of an order for the winding-up of the said company under the above Act should appear at the time of hearing, by himself or his counsel, for that purpose, and a copy of the petition will be furnished to any creditor or contributory of the said company requiring the same, by the undersigned, on payment of the regulated charge for the same.
