June 2.] THE NEW ZEALAND GAZETTE. 1439

Validating Public Notifications re Loan of £2,000 to form Streets in the Borough of Kaitangata.

RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this seventeenth day of May, 1904.

Present:
THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.

WHEREAS the Kaitangata Borough Council lately proposed to raise a loan of two thousand pounds for the formation of streets within the said borough:

And whereas the meeting of ratepayers was not held in accordance with the provisions of section nine of “The Local Bodies’ Loans Act, 1901,” inasmuch as the meeting was called on the eleventh day after the last publication of the notice referred to in the said section:

And whereas a special order making a special rate has been made as the security for the said loan, the public notifications of which are not in accordance with section seventy-three, subsection three, of “The Municipal Corporations Act, 1900,” inasmuch as the public notice required by the said subsection was not given once in each full week (as defined by the said Act) intervening between the meeting adopting and the meeting confirming such resolution, though such notice was given once in each calendar week between such meetings:

And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such irregularities:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the said meeting of ratepayers and the said special order shall be deemed and taken as valid to all intents and purposes as though the same were regular in form and in accordance with the provisions of “The Local Bodies’ Loans Act, 1901,” and “The Municipal Corporations Act, 1900,” respectively.

ALEX. WILLIS,
Clerk of the Executive Council.
