And whereas the Maniapoto-Tuwharetoa District Maori Land Council has recommended that the interests of Tohengaroa te Rauroha, Whakairi Wananga, Wiki Tohengaroa (alias Wiki Whakairi), Kino Tohengaroa (alias Kino Whakairi), and Peehihua Tohengaroa (alias Peehihua Whakairi), being owners in the block or parcel of land known as Karuotewhenua B No. 2b No. 5, be excepted from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of lease:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease, the interests of Tohengaroa te Rauroha, Whakairi Wananga, Wiki Tohengaroa (alias Wiki Whakairi), Kino Tohengaroa (alias Kino Whakairi), and Peehihua Tohengaroa (alias Peehihua Whakairi), in the block or parcel of land, situate in the Provincial District of Auckland, known as Karuotewhenua B No. 2b No. 5, and being the land comprised in partition order of the Native Land Court dated twenty-eighth January, one thousand nine hundred and one, in favour of Arapata te Rangituataka and others.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-ninth day of February, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas the Maniapoto-Tuwharetoa District Maori Land Council has recommended that the blocks or parcels of land mentioned and particularised in the Schedule hereto be excepted from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by section four of “The Native Land Laws Amendment Act, 1895,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the blocks or parcels of land mentioned and particularised in the Schedule hereto.


SCHEDULE.

ALL that block or parcel of land situate in the Provincial District of Auckland, containing 1,800 acres, being part of the land known as Mangaawakino No. 3, and part of the land contained in partition order of the Native Land Court dated the 25th June, 1902, in favour of Te Amoroa Ngatohu and others.

All that block or parcel of land situate in the Provincial District of Auckland, containing 130 acres, more or less, being the land known as Mangaawakino No. 5, and being the whole of the land contained in partition order of the Native Land Court dated the 9th July, 1892, in favour of Ngareta te Rira and others.

Regulations.—Manual and Technical Instruction.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-ninth day of February, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by “The Manual and Technical Instruction Act, 1900,” and “The Manual and Technical Instruction Act, 1902,” and of all other powers and authorities him enabling in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke clause 51 of the regulations made by Order in Council dated the twenty-second day of August, one thousand nine hundred and one, under the authority of the Act first hereinbefore mentioned, and in lieu thereof doth make the regulation set forth in the Schedule hereto.


SCHEDULE.

  1. In every case where the controlling authority, a public association, or a local authority makes a grant by lease or otherwise of any lands or buildings for the special purpose of encouraging the promotion or increasing the efficiency of classes, the grantor shall be deemed to contribute towards the cost of maintenance a sum not less than the annual value of the property comprised in the grant according to the assessment thereof for local rates.

Appointing Day for closing under “The Shops and Shop-assistants Act, 1894.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-ninth day of February, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the local authorities of the Town Districts of Otatau and Clyde, being duly authorised by “The Shops and Shop-assistants Act, 1894,” to appoint by special resolution, in the month of January, one thousand nine hundred and four, the day on which shops in the said town districts are to be closed in accordance with the said Act, have failed so to appoint a day:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the consent of the Executive Council of the said colony, and in exercise of the powers in this behalf conferred upon me by section ten of the said Act, do hereby appoint Wednesday to be the day on which shops shall be closed in the said town districts in accordance with the said Act.
