[No. 77

  1. No person shall fish for, take, or catch any fish in the said stream within a period of two years from the date of the publication hereof.

  2. Any person committing a breach of the above regulation shall be liable to a penalty of not less than £1 and not exceeding £50.

  3. Every penalty imposed by these regulations may be recovered in a summary manner before any two or more Justices of the Peace.

Validating Voting-paper used in connection with the Poll of Electors for Special Loan, Whangamarino Road District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Road Board of the District of Whangamarino lately proposed to raise a special loan of three thousand pounds for the purpose of making and metalling the main roads of said district: And whereas doubts have arisen as to the validity of the voting-paper used at the said poll: And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such voting-paper, and the proceedings taken therein:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers vested in him by “The Local Bodies’ Loans Amendment Act, 1902,” doth hereby declare that the voting-paper used at the taking of the said poll of electors shall be deemed and taken to be as valid to all intents and purposes as though the same were regular in form and in accordance with the provisions of the said Act; and, further, that no proceedings taken in relation to the use of the said voting-paper or consequent thereon shall be deemed to be insufficient or irregular by reason only of the invalidity or informality of such voting-paper.

Validating an Irregularity in the Publication of a Proposal to raise a Loan of £3,800, to be raised by the Akaroa Borough Council for the Drainage of the Borough.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Akaroa Borough Council lately proposed to raise a special loan of three thousand eight hundred pounds for drainage-works within the Borough of Akaroa: And whereas, in accordance with the provisions of “The Local Bodies’ Loans Act, 1901,” the proposal of the Council to raise the loan was published in the Akaroa Mail newspaper on the fourth, fourteenth, seventeenth, and twenty-fifth November, one thousand nine hundred and two, but such proposal was not advertised once in each week for four successive weeks, as required by the said Act: And whereas it is expedient to validate such irregularity:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in him by “The Local Bodies’ Loans Act, 1901,” and “The Local Bodies’ Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said colony, doth declare that the publication of the said proposal on the fourth, fourteenth, seventeenth, and twenty-fifth November, one thousand nine hundred and two, shall be deemed and taken to be as valid to all intents and purposes as if the said publication had been in accordance with the said Act; and, further, that no proceedings taken in relation to the said loan shall be deemed to be insufficient or irregular by reason only of the irregular publication of the said proposal as aforesaid.

Authorising the Exchange of a Portion of a Reserve in Wellington for other Land.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land described in the first column of the Schedule hereto forms part of the land which was permanently set apart for gravel purposes on the twenty-fifth day of December, one thousand eight hundred and ninety: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that described in the second column of the Schedule hereto:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” and the third section of “The Public Reserves Act Amendment Act, 1889,” doth hereby declare that the portion of the said reserve described in the first column of the Schedule hereto may be exchanged for the land described in the second column of the Schedule hereto.


SCHEDULE.

Description of Portion of Reserve intended to be exchanged. Description of Land to be obtained in Exchange therefor.
All that parcel of land in the Wellington Land District, containing by admeasurement 1 rood 38 perches, more or less, being part of Section No. 66, Block XI., Ongo Survey District. Bounded towards the north by Rangitikei Valley Road; towards the east by part of Section No. 59 of said block; towards the south by other part of said Section No. 66; and towards the west by Rangitikei Valley Road: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Wellington. All that parcel of land in the Wellington Land District, containing by admeasurement 1 rood 38 perches, more or less, being part of Section No. 59, Block XI., Ongo Survey District. Bounded towards the north by other part of Section No. 59 of said block; towards the east by other part of said Section No. 59; towards the south by Rangitikei Valley Road; and towards the west by part of Section No. 66 of said block: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Wellington.

Powers delegated to the Ellesmere Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of September, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-fourth day of October, one thousand eight hundred and ninety-eight, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the Ellesmere Domain Board, namely,—

THOMAS DEWAR BOAG, and
