Allocating Land reserved and taken for a Railway to the Purposes of a Road in Taranaki County.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for an extension of the Foxton–New Plymouth Railway from New Plymouth to the Breakwater at Moturoa, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister for Railways that such land is not required for railway purposes: And whereas such land is situated in Taranaki County, the local authority of which has assented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Taranaki County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE.

All that area in the Taranaki Land District, in the Paritutu Survey District, containing 1 acre and 37 perches, more or less, being a strip of railway reserve, for the most part 60 links wide, in Block IV. in said survey district. Bounded on the south-west, south, and south-east by the south-western, southern, and south-eastern boundary of the said railway reserve, distances of 899·1 links, 299·6 links, 214·6 links, 238·7 links, 278·9 links, and 257·9 links; on the west by Barrett Road, a distance of 69 links; and on the north-east and north by other portion of said railway reserve, distances of 933·1 links, 283·1 links, 202·7 links, 230·4 links, 258·3 links, and 264·8 links.

Also all that area in the Taranaki Land District, in the Paritutu Survey District, containing 1 acre 2 roods 25 perches, more or less, being a strip of railway reserve, for the most part 60 links wide, in Block IV. in said survey district. Bounded on the west and south-west by the western and south-western boundary of said railway reserve, distances of 146·5 links, 415·6 links, 267·2 links, 268·7 links, and 1696·3 links; on the east by Barrett Road, a distance of 69 links; and on the north-west, east, and north-east by other portions of the said railway reserve, distances of 60 links, 158·5 links, 415·6 links, 244·1 links, 121·5 links, 124·2 links, 868·3 links, and 794 links.

As the said parcels of land are more particularly delineated on the plan marked 11342, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured red.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this seventeenth day of January, in the year of our Lord one thousand nine hundred and three.
