Additional Land in the Town of East Winton taken for the Purposes of the Invercargill–Kingston Railway.

A PROCLAMATION.

WHEREAS it has been found desirable for the use, convenience, and enjoyment of the Invercargill–Kingston Railway to take further land in the Town of East Winton, in addition to land previously acquired for the purposes of the said railway:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers and authorities conferred on me by sections twenty-eight and one hundred and sixty-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is taken for the purposes above mentioned.

Vesting Control of the Waiohine Bridge in Wairarapa South County Council, and apportioning Cost of Maintenance.

A PROCLAMATION.

WHEREAS by section one hundred and fourteen of “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor may, upon the terms and conditions in the said section mentioned, by Proclamation publicly notified, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Proclamation, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Proclamation; and may by any such Proclamation as aforesaid fix and determine whether all or any, and, if so, what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge, is to be provided and paid by the local authority or local authorities, and, if so, by what local authority or authorities; and may by any such Proclamation as aforesaid direct how, where, and to whom such payment is to be made:

And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct that the bridge described in the Schedule hereto, and known as the Waiohine Bridge, shall, from and after the date of this Proclamation, be under the exclusive care and control of the Wairarapa South County Council; and in further pursuance of the aforesaid powers and authorities I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge shall be borne by the Council of the County of Wairarapa South and the Council of the County of Featherston in equal proportions of one-half of the cost respectively:

And I do also hereby further direct that any contribution hereby required to be made as aforesaid by the Council of the County of Featherston shall be paid from time to time respectively, in the proportion hereinbefore prescribed, out of the funds of the said county, within a period of thirty days after demand in writing made by or on behalf of the Council of the County of Wairarapa South; and all such payments shall be made from time to time to the Clerk of the said Council for and on account of such Council.

SCHEDULE.

The bridge over the Waiohine River on the main road from Greytown to Carterton, as the site of the said bridge is delineated upon the plan marked R. 4435, deposited in the office of the Chief Engineer of Roads, at Wellington.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a portion of the Paeroa–Waihi Railway:

And whereas all conditions precedent required by law to be observed and performed prior to the taking of such land in the manner hereby provided have been observed and performed:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers and authorities conferred on me by section one hundred and sixty-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is taken for a portion of the said line of railway hereinbefore specified.
