Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-fifth day of February, in the year of our Lord one thousand nine hundred and three.

Taking Lyttelton Gasworks, and vesting them in the Borough of Lyttelton.

A PROCLAMATION.

WHEREAS “The Lyttelton Borough Council Empowering Act, 1901” (hereinafter called “the empowering Act”), authorises the Borough Council of the Borough of Lyttelton, on behalf of the corporation of the said borough (hereinafter called “the Council”), to acquire and take the undertaking of the Lyttelton Gas, Coal, and Coke Company (Limited), (hereinafter called “the company”), in the manner provided by the empowering Act and “The Public Works Act, 1894”:

And whereas an agreement has been entered into between the Council and the company, in terms of section twenty-six of “The Public Works Act, 1894,” to take the said undertaking as provided by the empowering Act:

And whereas the said undertaking includes the land described in the Schedule hereto:

And whereas the intention to acquire the said undertaking has been gazetted and twice publicly notified, as required by section five of the empowering Act:

And whereas the Council has laid before the Governor a memorial defining the undertaking to be acquired, and has in all other respects complied with the provisions of the empowering Act and “The Public Works Act, 1894”:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in me by “The Public Works Act, 1894,” the empowering Act, and of every other power and authority in anywise enabling me in this behalf, and being satisfied of the sufficiency of the said agreement, do hereby proclaim and declare that, as on and from the first day of December, one thousand nine hundred and two, the said undertaking (being the undertaking as defined in section three of the empowering Act), including the land described in the Schedule hereto, is hereby acquired and taken, and shall vest in the Council, as on and from that date accordingly.

SCHEDULE.

ALL that parcel of land, situate in the Town of Lyttelton, containing 1 rood 20 perches, more or less, being Section No. 326 and the north-western half of Section 327, included in conveyance dated the 19th day of June, 1874, registered as No. 41656 in the office of the Registrar of Deeds, Canterbury, from John Grubb to the Lyttelton Gas, Coal, and Coke Company (Limited); also all that parcel of land, situate in the Town of Lyttelton, containing 20 perches, more or less, being the south-easternmost half of Section 327, included in conveyance dated the 19th day of September, 1874, registered as No. 42407 in the office aforesaid, from Robert Allan and Magnus Allan to the Lyttelton Gas, Coal, and Coke Company (Limited); and also all that parcel of land, situate in the Town of Lyttelton, containing 20 perches

or thereabouts, being the south-east half of Section 323, included in certificate of title, Vol. cxlv., folio 156.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-eighth day of February, in the year of our Lord one thousand nine hundred and three.

A PROCLAMATION.

IN pursuance and in exercise of the powers conferred by section thirteen of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, with the consents of the owners of the lands hereinafter mentioned, and with the consent of the Waiapu County Council, being the local authority in whose district the said lands are situated, do by this notice hereby proclaim as taken for a road the lands in the Mangaporo and Waiapu Survey Districts, hereinafter described, that is to say,—

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-eighth day of February, in the year of our Lord one thousand nine hundred and three.
