Removal of Restrictions on Alienation of Native Land.

RANFURLY, Governor.

WHEREAS application has been made to the Governor by the owner of the land described in the Schedule hereto, praying that the restrictions on the alienation of such land as set forth in the Native Land Court certificate of title bearing date the sixth day of June, one thousand eight hundred and eighty-one, and now contained in partition order of the Native Land Court bearing date the ninth day of August, one thousand eight hundred and ninety-nine, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that all restrictions imposed by the said Native Land Court certificate of title and partition order on the alienation of the said land are hereby removed.


SCHEDULE.

All that parcel of land, containing 4 acres, more or less, situate in the Provincial District of Wellington, known as Okurupatu A No. 2, Subdivision No. 2, held under partition order of the Native Land Court, dated the 9th day of August, 1899, in favour of Matire Kawana, and containing the following restrictions: “Inalienable, except with the consent of the Governor, by sale or mortgage, or by lease for a longer period than twenty-one years.”

As witness the hand of His Excellency the Governor, this seventh day of November, one thousand nine hundred and two.

Warrant authorising the Council of the Borough of Lower Hutt to construct a Bridge over the Hutt River, within the Borough of Lower Hutt, and apportioning the Cost.

WHEREAS by section two hundred and nineteen of “The Municipal Corporations Act, 1900” (hereinafter termed “the said Act”), it is, inter alia, enacted that in any case where the Council of any borough desires to construct, lengthen, or wholly or partially rebuild, or make approaches or protection-works to, a bridge, in any position that will, in its opinion, be of advantage or benefit to the whole or any considerable portion of the inhabitants of an adjacent borough or county or other district, as well as to the inhabitants of its own district, and where it is, in the opinion of such Council, reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing any such work, the provisions of the said section shall have effect:

And whereas the Council of the Borough of Lower Hutt has duly given the notice and taken the steps required by the said section and the regulations thereunder, and has made application to me to authorise the construction of the bridge and approaches mentioned in the Schedule hereto (hereinafter referred to as “the said bridge”), and to apportion the cost of constructing the said bridge between the said Council and the local authorities of the adjacent boroughs and districts as specified in the said notice:

And whereas the application was objected to, and for the purpose of considering the objections a Commissioner was duly appointed and an inquiry was duly held, and the Commissioner did report to me, after due inquiry, his opinion thereon: And whereas I am of opinion that the work should be done:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers and authorities vested in me by the said Act, and of all other powers and authorities enabling me in this behalf, do hereby authorise the Council of the Borough of Lower Hutt to execute the work. And I do hereby declare that the cost thereof, less any contribution made thereto by the Government of New Zealand, shall be borne by the Council of the Borough of Lower Hutt as the constructing local authority, and by the respective Councils of the County of Hutt, the Borough of Petone, and the City of Wellington, as contributing local authorities, in the following proportions—viz., the Council of the Borough of Lower Hutt to bear sixty per centum of such cost, the Council of the City of Wellington to bear twenty per centum of such cost, the Council of the Hutt County to bear twelve per centum of such cost, and the Council of the Borough of Petone to bear eight per centum of such cost; the proportions of the contributing authorities to be paid by instalments as the work proceeds, in manner provided by the said regulations.


SCHEDULE.

The bridge over the Hutt River, within the Borough of Lower Hutt, on the main Hutt Road, crossing part of Section 25, Block XIV., Belmont Survey District, together with the approaches to same at each end; as the site of the said bridge and approaches are delineated upon the plan marked R. 1149, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District.

As witness the hand of His Excellency the Governor, this eighth day of November, one thousand nine hundred and two.

Redefining Ridings in the County of Hawera.

WHEREAS, by an Order in Council dated the twenty-third day of October, one thousand nine hundred and two, made under “The Counties Act 1886 Amendment Act, 1895,” the boundaries of the Counties of Stratford, Patea, and Hawera were altered, and a certain area thereby added to the County of Hawera:

And whereas it is expedient to include the area so added to the County of Hawera in the Eltham and Hawera Ridings of the said county:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, Governor of the Colony of New Zealand, in pursuance of the powers vested in me by “The Counties Act, 1886,” do hereby declare that the area added to the County of Hawera shall be included in the Eltham and Hawera Ridings, and that the boundaries of the said ridings shall be those described in the Schedule hereto.


SCHEDULE.

ELTHAM RIDING.

All that area in the Taranaki Land District bounded towards the north generally by the Stratford County, as described in the New Zealand Gazette No. 85, 23rd October, 1902, from the Waingongoro River to the northern boundary of the Patea County: thence towards the east and south-east generally by Patea County, as described in the New Zealand Gazette No. 85, 23rd October, 1902, to the right bank of the Patea River: thence towards the south-west generally by the right bank of the Patea River to the north-western boundary-line of Tutaeariari No. 2 Block: thence towards
