Empowering Native Land Court to inquire and ascertain who are the Native Owners of Taupunga Ferry Reserve, Foxton.

ORDER IN COUNCIL.

At the Government House, at Wellington, this third day of July, 1902.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section fifteen of “The Native Land Court Act, 1894,” it is enacted that the Governor in Council may by Order from time to time confer on the Native Land Court, as established under the said Act, jurisdiction in any matter or question referred to in such Order exclusively affecting the rights of Natives in any real or personal property: And whereas by section nine of “The Reserves and Crown Lands Disposal and Enabling Act, 1896,” the Governor is empowered, upon their compliance with the conditions therein mentioned, to issue a Crown grant to certain aboriginal natives of New Zealand, members of the Ngatiahakatue Tribe, of part of Section 69, Foxton, known as the Taupunga Ferry Reserve: And whereas it is expedient that the Native Land Court should be empowered to inquire and ascertain who are the Natives so entitled, and in what shares and proportions:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him as aforesaid, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the investigation and determination of the matters aforesaid, and of any matter or question which may arise in relation thereto, or which it shall be necessary to determine for the purpose aforesaid, shall be and the same are hereby brought within the jurisdiction of the said Court: And it is hereby further declared that this Order shall take effect on and after the sixteenth day of August, one thousand nine hundred and two.

Authorising the Exchange of a Reserve in Canterbury for other Land.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of August, 1902.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the first column of the Schedule hereto was permanently set apart as a municipal reserve: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that described in the second column of the Schedule hereto:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” and the third section of “The Public Reserves Act Amendment Act, 1889,” doth hereby declare that the said reserve described in the first column of the Schedule hereto may be exchanged for the land described in the second column of the Schedule hereto.


SCHEDULE.

Description of Reserve intended to be exchanged. Description of Land to be obtained in Exchange therefor.
All that parcel of land in the Canterbury Land District, containing by admeasurement 1 rood, more or less, being Section No. 656 (part of Reserve No. 1642), Town of Ashburton. All that parcel of land in the Canterbury Land District, containing by admeasurement 1 rood, more or less, being Section No. 659, Town of Ashburton.

Consenting to Entry of Frank Bennett upon certain Native Blocks for the Purpose of taking and laying off a Road.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of August, 1902.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is, in section ninety-eight thereof, enacted that no surveyor shall enter upon any Native cultivation for the purpose of taking a road under the authority of the said Act without the previous consent of the Governor in Council:

And whereas the consent of the Governor in Council is required to the entry of Frank Bennett, authorised surveyor, upon the Native lands known as Moutere No. 3, Hanganoaiho, Hanganoaiho No. 1, Totaranui Nos. 11a, 11b, and 11c, and Kaingaraki No. 6 Blocks, situated in the Waitohu Survey District, in the Wellington Land District, for the purpose of taking and laying off a road-line through the said blocks:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the entry of the said Frank Bennett upon the said blocks for the purpose of taking and laying off a road-line.

Vesting a Reserve in the Mataura Borough Council.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of August, 1902.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto was permanently set aside as a reserve for municipal purposes on the fifth day of July, one thousand eight hundred and ninety-nine:

And whereas, in the opinion of the Governor, it is expedient to vest the said land in the Mataura Borough Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve mentioned in the Schedule hereto shall become vested in “The Mayor, Councillors, and Burgesses of the Borough of Mataura,” in trust, as a reserve for municipal purposes.


SCHEDULE.

All that parcel of land in the Land District of Southland, containing by admeasurement 38 perches, more or less, being Section No. 8, Block X., Town of Mataura Bridge. Bounded towards the north-west by Mataura Terrace, 259·5 links; towards the north-east by Section No. 7 of Block X. aforesaid, 130·1 links; towards the south-east by Section No. 9 of said Block, 250 links; and towards the south-west by Short Street, 60·5 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Invercargill.
