Powers delegated to the Courtenay Domain Board under “The Public Domains Act, 1881.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of July, 1902.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-eighth day of October, one thousand eight hundred and eighty-four, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the Courtenay Domain Board, namely,—

JOHN TURNER,
JAMES HARRIS BRETT,
HENRY MCNAE, and
WILLIAM JAMES JENKINS

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the second Tuesday in each month, at half-past seven o’clock p.m., at the Public Library, Courtenay, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Tuesday, the twelfth day of August, one thousand nine hundred and two.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Tuesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown land described in the Schedule hereto.

SCHEDULE.

All that parcel of land in the Canterbury Land District, containing by admeasurement 20 acres, more or less, being Reserve No. 2413 (in red), situated in Block VIII., Hawkins Survey District. Bounded towards the north-west and north-east by Reserve No. 178 (in red); towards the south-east by Rural Sections Nos. 3711, 3733, 3742, and 4247; and towards the south-west by Coal Road: as the same is delineated on the plan deposited in the District Lands and Survey Office at Christchurch.

Consenting to closing Road through Section 2, Block XIII., Uawa Survey District, Cook County.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of July, 1902.

Present:

His Excellency the Governor in Council.

WHEREAS by section twelve, subsection one, of “The Public Works Act Amendment Act, 1900,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:

And whereas the Cook County Council has applied for such consent in respect to the portion of the road described in the Schedule hereto:

Now, therefore, in pursuance and in exercise of the above in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the closing of the part of the road mentioned in the Schedule hereto.

In the Hawke’s Bay Land District; as the same is more particularly delineated on the plan marked R. 3834, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured as above noted.

Land temporarily reserved in the Land District of Canterbury.

RANFURLY, Governor.

WHEREAS by the two-hundred-and-thirty-fifth section of “The Land Act, 1892,” it is enacted that the Governor may from time to time, either by general or particular description, and whether the same has been surveyed or not, reserve from sale temporarily, notwithstanding that the same may be then held under pastoral license, any Crown land which in his opinion is required for any of the purposes in the said section mentioned:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in me by the said Act, do hereby temporarily reserve from sale the land in the Land District of Canterbury described in the Schedule hereunder written, for the purpose in the said Schedule specified at the end of the description of the land so intended to be temporarily reserved.

SCHEDULE.

All that area in the Land District of Canterbury, containing by admeasurement 5 acres, more or less, being Section No. 3569 (in red), Hekeao Settlement, Block III., Shepherd’s Bush Survey District. Bounded towards the north-west by a line running from Hekeao Road, parallel to Twentyman Road, 705·4 links; towards the north-east by a line running at right angles to the first-mentioned line as far as Twentyman Road; towards the south-east by the said Twentyman Road to Hekeao Road; and towards the west by the said Hekeao Road to the place of commencement: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 48613, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red. For a public-school site.

As witness the hand of His Excellency the Governor, this twenty-fifth day of July, one thousand nine hundred and two.
