Notice determining a Coal Lease.

To the Greymouth-Point Elizabeth Railway and Coal Company (Limited).

In the matter of a coal-mining lease dated the 10th day of December, 1888, granted by Her late Majesty Queen Victoria, of the one part, to Alexander Macdougall, of Wellington, Merchant; Robert Sloan, of Wellington, Tailor; James Barry, of Wellington, Builder; William McDowall, of Wellington, Builder; John Maclaren Miller, of Wellington, Coal Merchant; Joseph Taylor, of Cobden, Gentleman; John Taylor, of Greymouth, Gentleman; Gerald Perotti, of • Greymouth, Timber Merchant; Richard Nancarrow, of Greymouth, Auctioneer; and George McClatchie, of Christchurch, Coal Merchant, of the other part; and of an assignment of such lease dated the 5th day of March, 1895, from the said Alexander Macdougall, Robert Sloan, James Barry, William McDowall, John Maclaren Miller, Joseph Taylor, John Taylor, Gerald Perotti, Richard Nancarrow, and George McClatchie to the Greymouth-Point Elizabeth Railway and Coal Company (Limited), and comprising the parcel of land shortly described in the Schedule hereto.

TAKE notice that, as you have failed to pay the rents and royalties reserved by the said lease as and when the same respectively became due and payable, and such rents and royalties are now unpaid for the space of forty-two days and more (no rents or royalty having been paid since the 30th day of June, 1894), and as you have also failed to raise or to get any coal from the said lands, and generally have failed to perform or observe the several covenants and conditions to be performed by the lessee under the said lease and the assignment thereof, after notice in writing to perform, fulfil, or observe the same within twenty-one days from the date of the service thereof, and which said notice was served by delivering the same to Alexander Macdougall, Managing Director, personally, on the 20th day of December, 1901, I, Thomas Young Duncan, the Minister of Lands for the time being of the Colony of New Zealand, do hereby revoke, countermand, and determine the said deed of lease, and the several liberties, licenses, powers, and authorities thereby given or granted to you the said company, or intended so to be, or by the said assignment respectively.

ALL that piece or parcel of land, containing by admeasurement 4,000 acres, be the same more or less, situated in the Land District of Nelson, being Section No. 11, Block III., Cobden Survey District, and bounded as follows: On the north-eastward, 24999 links, by Crown land; on the south-eastward, 19064 links by Sections Nos. 2a and 231; on the south-westward, 4732 links by Crown lands, 6053 links by Sections Nos. 27 and 29, 1526 links by Section No. 29, 3048 links by a road reserve, and 15171 links by Crown land; and on the north-westward, 15109 links, by Crown lands.

ALL that parcel of land, containing by admeasurement 685 acres, be the same more or less, being part of the Grey Coal Reserve, situated in the Land District of Nelson, being Section No. 5, Block I., Cobden Survey District, and bounded as follows: On the northward, 11329 links, by Section 25; on the north-eastward, 1085 links, by Crown land; on the south-eastward, 15109 links, by Section 11; on the south-westward, 4043 links, by Crown land; and on the north-westward and westward by a reserve along the bank of Rocky Creek.

Port of Dunedin.—Defining Place beyond which Ships shall not pass until Pratique is granted.

IN pursuance of the provisions of the 116th section of “The Public Health Act, 1900,” I hereby give notice that, until pratique is granted by the Health Officer, ships from beyond sea arriving at the Port of Dunedin shall not be brought higher up the port than Boiler Point, on the bearing of N. 73° W. (magnetic).

DELAGOA BAY. — The pilot hulk, moored in approx. 25° 52¾′ S., 32° 54′ E., about 4 cables nrd. of the Cockburn Shoals pile lt., has been withdrawn, but a pilot-boat having pilots on board, and disting. by the letter “ P ” on her sails, will cruise, weather permitting, in the vicinity of Hope Shoal. Dec.

INDIAN OCEAN.

RANGOON RIVER ENTR.—From 1st Nov., 1901, the pilot vessel “ Guide ” will at night when at anchor carry a F. white lt. on the foretopsail yard-arm 43 ft. above the deck, and a similar lt. at the stern 15 ft. lower than the above. Dec.

PACIFIC OCEAN.

Fiji Islands.

VITI LEVU.—SUVA HARB.—On 1st Oct., 1901, 2 F. white lts., 6 ft. vert. apart, elev. 35 and 39 ft. respectively above H.W., were to be exh. from a square white house on black piles, in 18° 8¼′ S., 178° 24½′ E., on the nrn. extr. of the coral bank on the E. side of the entr. to the harb., with the Roman Catholic cathedral S. 89° E., 1⅓ miles, and Suva vu church N. 18° E. On the est. of these lts. the lt.-v. was to be withdrawn. Also, it is proposed to exh. a green lt. from each end of the new N. extension of the mole when completed (probably about end of Nov., 1901). The two mooring-buoys in the anchorage have been removed. Also that the wrk. of the barque “ Norden ” lies on the srn. edge of the wrn. reef at the entr., S. 43° W., 6½ cables from the new pile lt.-h. Dec.

ICE.—In Sept., 1901, the s.s. “ Mimiro ” reports passing large quantities of ice—about 300 bergs—in 55° S., and between 136° and 112° W. Dec.
