Powers delegated to the Cashmere Hills Domain Board under "The Public Domains Act, 1881."

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of February, 1902.
Present:
THE HONOURABLE J. CARROLL PRESIDING IN COUNCIL.
In pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-second day of May, one thousand eight hundred and ninety-seven, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Cashmere Hills Domain Board, namely,—
The CHAIRMAN OF THE SELWYN COUNTY COUNCIL,
His Worship the MAYOR OF THE CITY OF CHRISTCHURCH,
His Worship the MAYOR OF THE BOROUGH OF SYDENHAM,
The CHAIRMAN OF THE HEATHCOTE ROAD BOARD,
JOHN THOMPSON BROWN,
RICHARD WESTENRA,
WILLIAM DUNLOP, and
CHARLES DICKENSON MORRIS
(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—
- The Board shall meet for the transaction of business on the second Wednesday in each month, at three o’clock p.m.; at the office of the Selwyn County Council, Christchurch, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the ninth day of April, one thousand nine hundred and two.
- Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.
- Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.
- The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Wednesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.
- The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.
- If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.
- If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.
- All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown land described in the Schedule hereto.
SCHEDULE.
All that parcel of land in the Halswell Survey District, Canterbury Land District, containing by admeasurement 188 acres 3 roods 11 perches, more or less, being Reserve No. 161. Bounded towards the north by Section No. 2147. 4491·7 links; towards the east by Section No. 20922, 5256 links; towards the south by Sections Nos. 11227 and 11170, 4049·6 links; and towards the west by the Dyer’s Pass Road: subject nevertheless to a road-line, 1 chain wide, branching from the Dyer’s Pass Road, and leading to Section No. 11170: as the same is delineated on the official map in the District Lands and Survey Office, Christchurch.

At the Government Buildings, at Wellington, this twenty-first day of February, 1902.

Whereas by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the lands described in the Schedule hereto, situate in the Auckland Land District, are declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:
Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby, and in respect of the lands hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to
THE KATIKATI ROAD BOARD,
which shall be known as the Katikati Domain Board (herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—
- The Board shall meet for the transaction of business on the first Saturday in each month, at three o’clock p.m., at the Public Hall, Katikati, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Saturday, the fifth day of April, one thousand nine hundred and two.
- Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.
- Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.
- The Chairman of the Road Board shall be the Chairman of the Board, and shall have an original as well as a casting vote; he shall hold office until the election of his successor.

All that area in the Auckland Land District, being Section No. 26 of the Parish of Katikati, containing by admeasurement 105 acres 2 roods, more or less. Bounded towards the north-east by a road, 100 links wide, running along the shore of the Bay of Plenty; towards the south-east by a road, 100 links wide, running along the shore of the Katikati Harbour; towards the north by Section No. 25 of the Parish of Katikati, 2345 links; towards the south-west by said Section No. 25 and Section No. 24 of the same parish, 8883 links; and towards the north-west by a public road, 284 links and 920 links, to the point of commencement.
Also, all that area in the Auckland Land District, being Section No. 25 of the Parish of Katikati, containing by admeasurement 80 acres, more or less.
