given in favour of the candidates for any class than are to
be elected, the paper shall be treated as informal so far as
the said class is concerned, or if a ballot-paper does not show
clearly how a vote is to be recorded in regard to any candi-
date, or in regard to any question, it shall be considered
informal so far as the member’s intention is doubtful, and
no vote either way shall be recorded, but so much of the
paper as shows clearly the intention of the member shall
be accepted.
- A statement shall be prepared by the scrutineers,
showing in the case of each candidate, or in the case of
each question—firstly, the number of votes recorded against
and for the candidate or question, with the total number
so recorded; secondly, the numbers of informal or doubtful
votes of members who have sent in ballot-papers but have
abstained from voting. If there be an equality of votes
against or for a candidate, or against or for a proposition,
the candidate shall be deemed not elected, or the proposition
not carried, as the case may be.
Miscellaneous.

As soon as practicable after each annual meeting a
complete list shall be printed in the Journal next ensuing
of the office-bearers for the year, and of the members,
fellows, associates, honorary members, and students on the
roll of the Institute at the time of the annual meeting. The
report of the Council for the year and balance-sheet shall
likewise be printed in the same Journal. -
The name of any student who shall not before the
annual meeting have paid his subscription for the year then
current with arrears (if any), shall, if the Council so thinks
fit, be omitted from the roll of the Institute, and he shall
not be entitled to any of the privileges of the Institute; but
the Council may restore the name of such student to the roll
if all arrears are paid up to a later period. -
Any member whose subscription is six months in
arrear shall not be entitled to receive a ballot-paper for any
meeting; but, providing his subscription be not more than
twelve months in arrear, a letter (Form C) shall be sent to
him instead, and his ballot-paper shall be retained by the
Secretary, but may be given to the member after payment
of his subscription. -
When the subscriptions of any member are in arrear
for two years the Council shall send to such member, by
post, a notice in the Form D in the Schedule hereto. -
The Institute shall from time to time determine on
minimum scales of fees for surveying. -
Any person being a member, associate, fellow, or
student may, by notice in writing sent or delivered to the
Secretary, and upon payment of all arrears of subscriptions,
resign. -
Any charge against any member shall be investigated
by the Council, who may refer the matter to the Local
Committee of the district in which such member resides
for their opinion. The decision of the Council after such
investigation shall be final. -
The Council may suspend, or disqualify, or deprive of
his privileges any member, associate, fellow, or student—
(1.) If he is convicted of felony or misdemeanour;
(2.) If his license is cancelled or suspended by the Sur-
veyors’ Board pursuant to “The New Zealand
Institute of Surveyors and Board of Examiners
Act, 1900”;
(3.) Or on the ground of bad character, or for improper
or unprofessional conduct in his business as a
surveyor.
Before any person shall be so suspended, or disqualified, or
deprived of his privileges, the Council shall hold an inquiry
into the matter, and they shall serve notice of the place and
time of such inquiry (not being less than two months from
the services of such notice) specifying the alleged grounds
for such suspension, disqualification, or deprivation, and the
time and place for such inquiry, and such person shall be
heard, with such witnesses as he may produce, and may be
represented by counsel, and witnesses may be examined,
cross-examined, and re-examined as in civil cases. If not
less than five members of the Council shall, in writing, decide
that the grounds alleged for such suspension, disqualifica-
tion, or deprivation are sufficient and have been proved,
then the Council may disqualify or deprive such person or
may suspend such person for such time as it thinks fit.

The production of any document purporting to be a
true copy of any by-law or of any proceedings of the
Institute at any meeting, sealed with the corporate seal of
the Institute, and signed by the President and one member
of the Council, or by three members of the Council, shall be
conclusive evidence that such by-law was duly and lawfully
made, or that such proceedings took place, and that any
resolution appearing in such proceedings was duly and law-
fully arrived at. -
All by-laws and rules of the Institute are hereby re-
pealed, but such repeal shall not affect—
(1.) The validity, invalidity, effect, or consequence of
anything at the time of such repeal done or
suffered; or
(2.) Any then existing status or capacity; or
(3.) Any right, interest, or title then already acquired,
accrued, or established, or any remedy or pro-
ceeding in respect thereof; or
(4.) The proof of any past act or thing.
Notwithstanding such repeal every power and act which may
be necessary to complete, carry out, or compel the perform-
ance of any right under such repealed by-laws and rules
may be exercised and performed in all respects as if such
by-laws and rules remained in force, and all offences com-
mitted or penalties or forfeitures incurred before such repeal
may be prosecuted, punished, and enforced as if such by-laws
and rules had not been repealed.
