Land taken for a Native School in Waihou Survey District.
RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of October, 1901.
Present:
His Excellency the Governor in Council.
WHEREAS the land mentioned in the Schedule hereto is required to be taken, under “The Public Works Act, 1894,” and “The Public Works Acts Amendment Act, 1900,” for a certain public work, to wit, a Native school:
And whereas it has been made a condition of the establishment of the said Native school that the site required therefor shall be a free gift from the Native owners to His Majesty the King, and the Native owners have agreed to such condition, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:
And whereas by an order of the Native Land Court, made under the provisions of “The Native Land Court Act, 1886,” and its amendments, bearing date the nineteenth day of December, one thousand eight hundred and ninety-three, certain aboriginal natives, as in the said order mentioned, were declared to be the owners of the portion of the Tiri-tiri Block within which the said land is situated:
And whereas a map has been prepared in duplicate showing accurately the position and extent of the said land, and such map has been duly signed by the Surveyor-General and is hereto attached, and the Minister for Public Works has recommended that this Order in Council should be issued:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1894,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the lands shown upon the said map and mentioned in the Schedule hereto are hereby taken for the purposes of the said Native school: And it is hereby declared that this Order in Council shall take effect on the first day of December, one thousand nine hundred and one.

SCHEDULE.
KERIPEHI NATIVE-SCHOOL SITE.
All that parcel of land in the Auckland Land District, containing by admeasurement 3 acres, more or less, situated in Block VI., Waihou Survey District. Bounded towards the north-east by a right line bearing south 21° 15′ east, 600 links, from a point distant 231865·6 links south and 342110·6 links east from Mount Eden; thence towards the south-east by a right line bearing west 21° 15′ south, 500 links; thence towards the south-west by a right line bearing north 21° 15′ west, 600 links; and thence towards the north-west by a right line bearing east 21° 15′ north, 500 links, to the place of commencement: as the same is more particularly delineated on the plan marked 1900/1267, deposited in the office of the Minister of Education, at Wellington, in the Provincial District of Wellington, and thereon coloured red.

Dues and Rates for Cape Turnagain Jetty.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of October, 1901.

WHEREAS it is provided by section three of “The Harbours Act Amendment Act, 1883,” that the powers conferred by the seventeenth section of “The Harbours Act, 1878,” may be exercised from time to time:
And whereas by Order in Council dated the twenty-eighth day of August, one thousand eight hundred and ninety-nine, Hugh Handyside, Charles Herbert, and James Groves Speedy, as trustees for the inhabitants of the Cape Turnagain District, were authorised to construct a jetty at Cape Turnagain, as shown on plan marked M.D. 2285:
And whereas it is desirable that dues and rates should be prescribed for the use of the said wharf:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority conferred by “The Harbours Act, 1878,” and the amendments thereof, and of all other powers and authorities enabling him in this behalf, doth hereby prescribe that the dues and rates specified in the Schedule hereto shall be charged and taken, on and after the publication of this Order in Council in the New Zealand Gazette, for the use of the said jetty at Cape Turnagain, and doth further order that such dues shall be paid to the said trustees.

Increasing the Holding-area of Land to Settlers in the Karewarewa Village Settlement.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of October, 1901.
Present:
His Excellency the Governor in Council.
WHEREAS by an Order in Council issued on the thirtieth day of July, one thousand eight hundred and ninety-five, under the authority of the one-hundred-and-sixty-ninth section of “The Land Act, 1892,” fixing the terms and conditions upon which certain village-homestead allotments therein enumerated should be disposed of, it was provided that no person should apply for and hold more than one allotment:
And whereas it is expedient to allow one person to apply for and hold more than one allotment in the Karewarewa Village Settlement, provided that the area so acquired does not exceed one hundred acres:
Now, therefore, His Excellency the Governor, in pursuance of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby amend the Order in Council aforesaid so far as it affects the areas in which the land in the Karewarewa Village Settlement shall be held, and doth by this present Order declare that any settler in the village settlement aforesaid may apply for and acquire more than one allotment of land therein, provided that the total area acquired does not exceed one hundred acres. And it is hereby further declared that all the provisions of the Order in Council of the thirtieth day of July, one thousand eight hundred and ninety-five, aforesaid, shall apply, except as regards the area in which the land may be held, to the Karewarewa Village Settlement aforesaid.

Declaring Road in Tamai Hamlet to be a County Road.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of October, 1901.
Present:
His Excellency the Governor in Council.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the road defined in the Schedule below, and which was made by the Governor under the powers contained in the said Act, and has hitherto been a Government road, shall on and after the date of this Order in Council become a county road.

That road in Tamai Hamlet, in the Land District of Canterbury, known as Mackworth Street, situated in Block XII., Christchurch Survey District, extending from Matlock Street in the said hamlet to the city drains at the easternmost corner of Section No. 1 of the said hamlet: as the said road is delineated upon the plan marked S.G. 19206A, deposited in the Head Office of the Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon coloured green.
