Additional Land in Wairoa Survey District taken for the Purposes of the Foxton–New Plymouth Railway.

A PROCLAMATION.

WHEREAS it has been found desirable for the use, convenience, and enjoyment of the Foxton–New Plymouth Railway to take further land in Wairoa Survey District, in addition to land previously acquired for the purposes of the said railway:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers and authorities conferred on me by sections twenty-eight and one hundred and sixty-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is taken for the purposes above mentioned.

SCHEDULE.

The parcel of land mentioned hereunder:—

In the Wellington Land District; as the same is more particularly delineated on the plan marked 9186, deposited in the office of the Minister for Railways, at Wellington, in the Provincial District of Wellington, and thereon bordered red.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this fifteenth day of July, in the year of our Lord one thousand nine hundred and one.

Revoking Order in Council licensing Charles Spooner to occupy a Part of Foreshore at Waiwera River.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of August, 1901.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the fourth day of June, one thousand eight hundred and ninety-four, and published in the New Zealand Gazette No. 45, of the fourteenth day of the same month, His Excellency the Governor in Council did, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” license Charles Spooner, of Newmarket, Auckland, to use and occupy a part of the foreshore and land below low-water mark of the Waiwera River, in the Provincial District of Auckland, for the purpose of erecting and maintaining thereon a wharf in the position shown on, and in accordance with, plan marked M.D. 1925, and deposited in the office of the Marine Department at Wellington:

And whereas the said licensee has committed a breach of subclause two of clause thirteen of the conditions of the said Order in Council of the fourth day of June, one thousand eight hundred and ninety-four, by ceasing to use and occupy the wharf for a period of thirty days:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council, and every right, power, and privilege conferred thereby or intended so to be.

Revoking Order in Council authorising Construction of Harbour-works, Auckland Harbour.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of August, 1901.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by Order in Council dated the tenth day of September, one thousand nine hundred, and published in the New Zealand Gazette No. 79, of the thirteenth day of the same month, His Excellency the Governor in Council did, by special Order, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” authorise the Auckland Harbour Board to execute or construct a rubble embankment in Auckland Harbour, as shown on plan marked M.D. 2356, and deposited in the office of the Marine Department at Wellington:

And whereas it is desirable that the said authority should be revoked:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council, and every right, power, and privilege conferred thereby or intended so to be.

Authorising Construction of Harbour-works, Auckland Harbour.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourteenth day of August, 1901.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is provided by the fourth section of “The Harbours Act Amendment Act, 1883” (hereinafter termed “the said Act”), that whenever any Harbour Board is desirous of executing or constructing any harbour-works upon lands vested in such Board or upon lands of the Crown of such a nature that the same could, under “The Harbours Act, 1878,” only be carried out and executed under the authority of a special Act, the Board may apply to the Governor in Council for a special Order, and, if the Governor in Council thinks fit, such Order may be made and granted:

And whereas the Auckland Harbour Board (hereinafter called “the Board”) is desirous of executing or constructing a certain timber breastwork in Auckland Harbour upon lands vested in the Board, and the said work is of such a nature as aforesaid, and the Board has applied to the Governor in Council for the issue of a special Order:

And whereas the conditions precedent to the granting of a special Order prescribed by the said Act have been duly performed and observed, and it appears expedient that such Order should be made:

And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation:

Now, therefore, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise and empower the Board to execute or construct a timber breastwork in Auckland Harbour, as shown on plan marked M.D. 2446, such breastwork to be carried out and constructed in accordance with plan and specifications marked M.D. 2446, and subject to the provisions of the said Act. And it is hereby ordered and declared that the said work shall be completed on or before the thirty-first day of January, one thousand nine hundred and three.
